55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the employment of certified counselors by school
88 districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 33.002(b) and (c), Education Code, are
1111 amended to read as follows:
1212 (b) A school district with 300 [500] or more students in
1313 enrollment [enrolled in elementary school grades] shall employ a
1414 counselor certified under the rules of the State Board for Educator
1515 Certification for each [elementary] school in the district. A
1616 school district shall employ at least one counselor for every 300
1717 [500 elementary school] students in the district.
1818 (c) A school district with fewer than 300 [500] students in
1919 enrollment [enrolled in elementary school grades] shall provide
2020 guidance and counseling services to [elementary school] students
2121 by:
2222 (1) employing a part-time counselor certified under
2323 the rules of the State Board for Educator Certification;
2424 (2) employing a part-time teacher certified as a
2525 counselor under the rules of the State Board for Educator
2626 Certification; or
2727 (3) entering into a shared services arrangement
2828 agreement with one or more school districts to share a counselor
2929 certified under the rules of the State Board for Educator
3030 Certification.
3131 SECTION 2. Section 42.152(i), Education Code, is amended to
3232 read as follows:
3333 (i) From the total amount of funds appropriated for
3434 allotments under this section, the commissioner shall, each fiscal
3535 year, withhold $7,500,000 or a greater amount as determined in the
3636 General Appropriations Act and distribute that amount for programs
3737 under Subchapter A, Chapter 33. Funds distributed under this
3838 subsection are in addition to any other funds available for
3939 programs under Subchapter A, Chapter 33, including funds provided
4040 under Section 42.2519. [A program established under that subchapter
4141 is required only in school districts in which the program is
4242 financed by funds distributed under this section or other funds
4343 distributed by the commissioner for a program under that
4444 subchapter. In distributing those funds, preference shall be given
4545 to a school district that received funds for a program under this
4646 subsection for the preceding school year.]
4747 SECTION 3. Subchapter E, Chapter 42, Education Code, is
4848 amended by adding Section 42.2519 to read as follows:
4949 Sec. 42.2519. ADDITIONAL STATE AID FOR CERTIFIED
5050 COUNSELORS. (a) For each school year, from funds that may be used
5151 for the purpose, a school district is entitled to state aid in an
5252 amount, as determined by the commissioner, sufficient to assist the
5353 district in employing the number of certified counselors required
5454 by Section 33.002.
5555 (b) The amount of state aid to which a school district is
5656 entitled under this section is in addition to the amount of revenue
5757 to which the district is entitled under Section 42.2516(b).
5858 (c) The commissioner shall adopt rules as necessary to
5959 administer this section.
6060 SECTION 4. Section 33.002(a), Education Code, is repealed.
6161 SECTION 5. This Act applies beginning with the 2009-2010
6262 school year.
6363 SECTION 6. This Act takes effect September 1, 2009.
