7 | 7 | | relating to the employment of certified counselors by school |

9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

10 | 10 | | SECTION 1. Sections 33.002(b) and (c), Education Code, are |
---|
11 | 11 | | amended to read as follows: |
---|
12 | 12 | | (b) A school district with 300 [500] or more students in |
---|
13 | 13 | | enrollment [enrolled in elementary school grades] shall employ a |
---|
14 | 14 | | counselor certified under the rules of the State Board for Educator |
---|
15 | 15 | | Certification for each [elementary] school in the district. A |
---|
16 | 16 | | school district shall employ at least one counselor for every 300 |
---|
17 | 17 | | [500 elementary school] students in the district. |
---|
18 | 18 | | (c) A school district with fewer than 300 [500] students in |
---|
19 | 19 | | enrollment [enrolled in elementary school grades] shall provide |
---|
20 | 20 | | guidance and counseling services to [elementary school] students |
---|
21 | 21 | | by: |
---|
22 | 22 | | (1) employing a part-time counselor certified under |
---|
23 | 23 | | the rules of the State Board for Educator Certification; |
---|
24 | 24 | | (2) employing a part-time teacher certified as a |
---|
25 | 25 | | counselor under the rules of the State Board for Educator |
---|
26 | 26 | | Certification; or |
---|
27 | 27 | | (3) entering into a shared services arrangement |
---|
28 | 28 | | agreement with one or more school districts to share a counselor |
---|
29 | 29 | | certified under the rules of the State Board for Educator |
---|
30 | 30 | | Certification. |
---|
31 | 31 | | SECTION 2. Section 42.152(i), Education Code, is amended to |
---|
32 | 32 | | read as follows: |
---|
33 | 33 | | (i) From the total amount of funds appropriated for |
---|
34 | 34 | | allotments under this section, the commissioner shall, each fiscal |
---|
35 | 35 | | year, withhold $7,500,000 or a greater amount as determined in the |
---|
36 | 36 | | General Appropriations Act and distribute that amount for programs |
---|
37 | 37 | | under Subchapter A, Chapter 33. Funds distributed under this |
---|
38 | 38 | | subsection are in addition to any other funds available for |
---|
39 | 39 | | programs under Subchapter A, Chapter 33, including funds provided |
---|
40 | 40 | | under Section 42.2519. [A program established under that subchapter |
---|
41 | 41 | | is required only in school districts in which the program is |
---|
42 | 42 | | financed by funds distributed under this section or other funds |
---|
43 | 43 | | distributed by the commissioner for a program under that |
---|
44 | 44 | | subchapter. In distributing those funds, preference shall be given |
---|
45 | 45 | | to a school district that received funds for a program under this |
---|
46 | 46 | | subsection for the preceding school year.] |
---|
47 | 47 | | SECTION 3. Subchapter E, Chapter 42, Education Code, is |
---|
48 | 48 | | amended by adding Section 42.2519 to read as follows: |
---|
49 | 49 | | Sec. 42.2519. ADDITIONAL STATE AID FOR CERTIFIED |
---|
50 | 50 | | COUNSELORS. (a) For each school year, from funds that may be used |
---|
51 | 51 | | for the purpose, a school district is entitled to state aid in an |
---|
52 | 52 | | amount, as determined by the commissioner, sufficient to assist the |
---|
53 | 53 | | district in employing the number of certified counselors required |
---|
54 | 54 | | by Section 33.002. |
---|
55 | 55 | | (b) The amount of state aid to which a school district is |
---|
56 | 56 | | entitled under this section is in addition to the amount of revenue |
---|
57 | 57 | | to which the district is entitled under Section 42.2516(b). |
---|
58 | 58 | | (c) The commissioner shall adopt rules as necessary to |
---|
59 | 59 | | administer this section. |
---|
60 | 60 | | SECTION 4. Section 33.002(a), Education Code, is repealed. |
---|
61 | 61 | | SECTION 5. This Act applies beginning with the 2009-2010 |
---|
62 | 62 | | school year. |
---|
63 | 63 | | SECTION 6. This Act takes effect September 1, 2009. |
