| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 502.0071, Transportation Code, is | |
| 11 | 11 | amended to read as follows: | |
| 12 | 12 | Sec. 502.0071. GOLF CARTS. An owner of a golf cart is not | |
| 13 | 13 | required to register the golf cart if: | |
| 14 | 14 | (1) the operation of the golf cart occurs in the | |
| 15 | 15 | daytime, as defined by Section 541.401; and | |
| 16 | 16 | (2) the operation: | |
| 17 | 17 | (A) does not exceed a distance of two miles from | |
| 18 | 18 | the point of origin to the destination [if driven to and from a golf | |
| 19 | 19 | course]; | |
| 20 | 20 | (B) originates in [occurs entirely within] a | |
| 21 | 21 | master planned community with a uniform set of restrictive | |
| 22 | 22 | covenants that has had a plat approved by a county or a | |
| 23 | 23 | municipality; or | |
| 24 | 24 | (C) occurs on a public or private beach. | |
| 25 | 25 | SECTION 2. This Act takes effect September 1, 2009. |
