| 10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 11 | 11 | | SECTION 1. Section 419.038, Government Code, is amended by |
|---|
| 12 | 12 | | amending Subsection (a) and adding Subsection (d) to read as |
|---|
| 13 | 13 | | follows: |
|---|
| 14 | 14 | | (a) The commission shall adopt requirements for |
|---|
| 15 | 15 | | certification of aircraft fire fighting and rescue fire protection |
|---|
| 16 | 16 | | personnel. A person may not be appointed to an aircraft fire |
|---|
| 17 | 17 | | fighting and rescue fire protection personnel position, except on a |
|---|
| 18 | 18 | | probationary basis, unless the person: |
|---|
| 19 | 19 | | (1) has completed the training prescribed by the |
|---|
| 20 | 20 | | commission; or |
|---|
| 21 | 21 | | (2) meets the requirements of Subsection (d). |
|---|
| 22 | 22 | | (d) A person is considered to have satisfied the training |
|---|
| 23 | 23 | | requirements of this section and may be appointed to an aircraft |
|---|
| 24 | 24 | | fire fighting and rescue fire protection personnel position if the |
|---|
| 25 | 25 | | person is employed at an airport that: |
|---|
| 26 | 26 | | (1) is classified as a Class IV airport under 14 C.F.R. |
|---|
| 27 | 27 | | Part 139; and |
|---|
| 28 | 28 | | (2) holds an Airport Operating Certificate issued |
|---|
| 29 | 29 | | under 14 C.F.R. Part 139. |
|---|
| 30 | 30 | | SECTION 2. The changes in law made by this Act apply to |
|---|
| 31 | 31 | | aircraft fire fighting and rescue fire protection personnel |
|---|
| 32 | 32 | | appointed under Section 419.038, Government Code, without regard to |
|---|
| 33 | 33 | | whether the personnel were appointed on, before, or after the |
|---|
| 34 | 34 | | effective date of this Act. |
|---|
| 35 | 35 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 36 | 36 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 37 | 37 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 38 | 38 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 39 | 39 | | Act takes effect September 1, 2009. |
