66 AN ACT
77 relating to an exemption from Texas Commission on Fire Protection
88 training requirements for certain aircraft fire fighting and rescue
99 fire protection personnel.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 419.038, Government Code, is amended by
1212 amending Subsection (a) and adding Subsection (d) to read as
1313 follows:
1414 (a) The commission shall adopt requirements for
1515 certification of aircraft fire fighting and rescue fire protection
1616 personnel. A person may not be appointed to an aircraft fire
1717 fighting and rescue fire protection personnel position, except on a
1818 probationary basis, unless the person:
1919 (1) has completed the training prescribed by the
2020 commission; or
2121 (2) meets the requirements of Subsection (d).
2222 (d) A person is considered to have satisfied the training
2323 requirements of this section and may be appointed to an aircraft
2424 fire fighting and rescue fire protection personnel position if the
2525 person is employed at an airport that:
2626 (1) is classified as a Class IV airport under 14 C.F.R.
2727 Part 139; and
2828 (2) holds an Airport Operating Certificate issued
2929 under 14 C.F.R. Part 139.
3030 SECTION 2. The changes in law made by this Act apply to
3131 aircraft fire fighting and rescue fire protection personnel
3232 appointed under Section 419.038, Government Code, without regard to
3333 whether the personnel were appointed on, before, or after the
3434 effective date of this Act.
3535 SECTION 3. This Act takes effect immediately if it receives
3636 a vote of two-thirds of all the members elected to each house, as
3737 provided by Section 39, Article III, Texas Constitution. If this
3838 Act does not receive the vote necessary for immediate effect, this
3939 Act takes effect September 1, 2009.
