9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 548.104(d), Transportation Code, is | |
11 | 11 | amended to read as follows: | |
12 | 12 | (d) An inspection station or inspector may not issue an | |
13 | 13 | inspection certificate for a vehicle equipped with: | |
14 | 14 | (1) a carburetion device permitting the use of | |
15 | 15 | liquefied gas alone or interchangeably with another fuel, unless a | |
16 | 16 | valid liquefied gas tax decal issued by the comptroller is attached | |
17 | 17 | to the lower right-hand corner of the front windshield of the | |
18 | 18 | vehicle on the passenger side; [or] | |
19 | 19 | (2) a sunscreening device prohibited by Section | |
20 | 20 | 547.613, except that the department by rule shall provide | |
21 | 21 | procedures for issuance of an inspection certificate for a vehicle | |
22 | 22 | exempt under Section 547.613(c); or | |
23 | 23 | (3) a device that allows nitrous oxide to combine with | |
24 | 24 | gasoline for the purpose of increasing engine power, except the | |
25 | 25 | certificate may be issued if the container of nitrous oxide has been | |
26 | 26 | removed from the vehicle and the device has been disabled. | |
27 | 27 | SECTION 2. This Act takes effect September 1, 2009. |
