88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. The heading to Title 10, Human Resources Code, is
1010 amended to read as follows:
1111 TITLE 10. JUVENILE BOARDS, JUVENILE PROBATION DEPARTMENTS, [AND]
1212 FAMILY SERVICES OFFICES, AND OTHER JUVENILE JUSTICE SERVICES
1313 SECTION 2. The heading to Subtitle A, Title 10, Human
1414 Resources Code, is amended to read as follows:
1515 SUBTITLE A. JUVENILE PROBATION SERVICES AND OTHER JUVENILE
1616 JUSTICE SERVICES
1717 SECTION 3. Subchapter C, Chapter 141, Human Resources Code,
1818 is amended by adding Section 141.0422 to read as follows:
1919 Sec. 141.0422. MINIMUM STANDARDS FOR JUVENILE CASE
2020 MANAGERS. (a) The commission shall adopt reasonable rules for
2121 juvenile case managers employed under Article 45.056, Code of
2222 Criminal Procedure, that provide:
2323 (1) a code of ethics, and for the enforcement of that
2424 code;
2525 (2) minimum education requirements; and
2626 (3) minimum training standards, including
2727 requirements that each juvenile case manager receives training in:
2828 (A) the role of the juvenile case manager;
2929 (B) case planning and management;
3030 (C) juvenile law;
3131 (D) courtroom proceedings and presentation;
3232 (E) law enforcement proceedings;
3333 (F) local programs and services for juveniles and
3434 methods by which juveniles may access those programs and services;
3535 and
3636 (G) detecting and preventing abuse,
3737 exploitation, and neglect of children.
3838 (b) To the extent possible, the commission shall adopt rules
3939 substantially similar to the rules applicable to juvenile probation
4040 officers that the commission adopts under Section 141.042.
4141 SECTION 4. Not later than December 1, 2009, the Texas
4242 Juvenile Probation Commission shall adopt the rules required by
4343 Section 141.0422, Human Resources Code, as added by this Act.
4444 SECTION 5. This Act takes effect immediately if it receives
4545 a vote of two-thirds of all the members elected to each house, as
4646 provided by Section 39, Article III, Texas Constitution. If this
4747 Act does not receive the vote necessary for immediate effect, this
4848 Act takes effect September 1, 2009.
