66 AN ACT
77 relating to compensatory time accrued by a correctional officer
88 employed by the Texas Department of Criminal Justice.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 659, Government Code, is
1111 amended by adding Section 659.0156 to read as follows:
1212 Sec. 659.0156. PAYMENT TO CORRECTIONAL OFFICER FOR UNUSED
1313 COMPENSATORY TIME. (a) A correctional officer employed by the
1414 Texas Department of Criminal Justice who is entitled to
1515 compensatory time off under Section 659.015 or 659.016 and who, on
1616 the anniversary of the date on which the correctional officer began
1717 employment, has not used all of the correctional officer's accrued
1818 compensatory time, is entitled to payment for the accrued
1919 compensatory time if the correctional officer:
2020 (1) was not subject to a disciplinary action during
2121 the preceding 12-month period, including a disciplinary action for
2222 a violation of the leave with pay policy; and
2323 (2) received an evaluation of at least satisfactory in
2424 the correctional officer's most recent performance evaluation.
2525 (b) A correctional officer who is paid for accrued
2626 compensatory time under Subsection (a) shall be paid:
2727 (1) at the rate described by Section 659.015(c)(2), if
2828 the employee is covered by Section 659.015; and
2929 (2) at the rate equal to the correctional officer's
3030 regular rate of pay, notwithstanding Section 659.016(i), if the
3131 employee is covered by Section 659.016.
3232 SECTION 2. This Act takes effect September 1, 2009.
