| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 659, Government Code, is |
|---|
| 11 | 11 | | amended by adding Section 659.0156 to read as follows: |
|---|
| 12 | 12 | | Sec. 659.0156. PAYMENT TO CORRECTIONAL OFFICER FOR UNUSED |
|---|
| 13 | 13 | | COMPENSATORY TIME. (a) A correctional officer employed by the |
|---|
| 14 | 14 | | Texas Department of Criminal Justice who is entitled to |
|---|
| 15 | 15 | | compensatory time off under Section 659.015 or 659.016 and who, on |
|---|
| 16 | 16 | | the anniversary of the date on which the correctional officer began |
|---|
| 17 | 17 | | employment, has not used all of the correctional officer's accrued |
|---|
| 18 | 18 | | compensatory time, is entitled to payment for the accrued |
|---|
| 19 | 19 | | compensatory time if the correctional officer: |
|---|
| 20 | 20 | | (1) was not subject to a disciplinary action during |
|---|
| 21 | 21 | | the preceding 12-month period, including a disciplinary action for |
|---|
| 22 | 22 | | a violation of the leave with pay policy; and |
|---|
| 23 | 23 | | (2) received an evaluation of at least satisfactory in |
|---|
| 24 | 24 | | the correctional officer's most recent performance evaluation. |
|---|
| 25 | 25 | | (b) A correctional officer who is paid for accrued |
|---|
| 26 | 26 | | compensatory time under Subsection (a) shall be paid: |
|---|
| 27 | 27 | | (1) at the rate described by Section 659.015(c)(2), if |
|---|
| 28 | 28 | | the employee is covered by Section 659.015; and |
|---|
| 29 | 29 | | (2) at the rate equal to the correctional officer's |
|---|
| 30 | 30 | | regular rate of pay, notwithstanding Section 659.016(i), if the |
|---|
| 31 | 31 | | employee is covered by Section 659.016. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2009. |
