| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Subchapter B, Chapter 531, Health and Safety |
|---|
| 11 | 11 | | Code, is amended by adding Section 531.0281 to read as follows: |
|---|
| 12 | 12 | | Sec. 531.0281. FEDERAL FUNDING FOR ABSTINENCE-ONLY |
|---|
| 13 | 13 | | EDUCATION. (a) In this section, "abstinence-only education" means |
|---|
| 14 | 14 | | an educational or motivational program that does not include |
|---|
| 15 | 15 | | information about preventing pregnancy, sexually transmitted |
|---|
| 16 | 16 | | diseases, infection with human immunodeficiency virus, or acquired |
|---|
| 17 | 17 | | immune deficiency syndrome through any means other than total |
|---|
| 18 | 18 | | abstinence from sexual activity. |
|---|
| 19 | 19 | | (b) The commission may not apply for or accept federal |
|---|
| 20 | 20 | | funds, including funds under Section 510, Social Security Act (42 |
|---|
| 21 | 21 | | U.S.C. Section 710), for abstinence-only education. |
|---|
| 22 | 22 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 23 | 23 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 24 | 24 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 25 | 25 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 26 | 26 | | Act takes effect September 1, 2009. |
