99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Health and Safety
1111 Code, is amended by adding Section 531.0281 to read as follows:
1212 Sec. 531.0281. FEDERAL FUNDING FOR ABSTINENCE-ONLY
1313 EDUCATION. (a) In this section, "abstinence-only education" means
1414 an educational or motivational program that does not include
1515 information about preventing pregnancy, sexually transmitted
1616 diseases, infection with human immunodeficiency virus, or acquired
1717 immune deficiency syndrome through any means other than total
1818 abstinence from sexual activity.
1919 (b) The commission may not apply for or accept federal
2020 funds, including funds under Section 510, Social Security Act (42
2121 U.S.C. Section 710), for abstinence-only education.
2222 SECTION 2. This Act takes effect immediately if it receives
2323 a vote of two-thirds of all the members elected to each house, as
2424 provided by Section 39, Article III, Texas Constitution. If this
2525 Act does not receive the vote necessary for immediate effect, this
2626 Act takes effect September 1, 2009.
