| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Article 56.01(3), Code of Criminal Procedure, as | |
| 11 | 11 | amended by Chapters 66 (H.B. 1489) and 268 (S.B. 6), Acts of the | |
| 12 | 12 | 79th Legislature, Regular Session, 2005, is reenacted and amended | |
| 13 | 13 | to read as follows: | |
| 14 | 14 | (3) "Victim" means a person who is the victim of the | |
| 15 | 15 | offense of sexual assault, kidnapping, aggravated robbery, | |
| 16 | 16 | trafficking of persons, or injury to a child, elderly individual, | |
| 17 | 17 | or disabled individual or who has suffered personal injury or death | |
| 18 | 18 | as a result of the criminal conduct of another. | |
| 19 | 19 | SECTION 2. This Act takes effect immediately if it receives | |
| 20 | 20 | a vote of two-thirds of all the members elected to each house, as | |
| 21 | 21 | provided by Section 39, Article III, Texas Constitution. If this | |
| 22 | 22 | Act does not receive the vote necessary for immediate effect, this | |
| 23 | 23 | Act takes effect September 1, 2009. |
