| 14 | 14 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 15 | 15 | | SECTION 1. Subchapter A, Chapter 37, Education Code, is |
|---|
| 16 | 16 | | amended by adding Section 37.0181 to read as follows: |

| 17 | 17 | | Sec. 37.0181. STAFF DEVELOPMENT REGARDING DISCIPLINARY |
|---|
| 18 | 18 | | PROCEDURES. |
|---|
| 19 | 19 | | (a) Each principal or other appropriate administrator who |
|---|
| 20 | 20 | | oversees student discipline shall, at least once every three (3) |
|---|
| 21 | 21 | | school years, attend staff development training regarding |
|---|
| 22 | 22 | | Subchapter A, Chapter 37, including information relating to the |
|---|
| 23 | 23 | | distinction between a discipline management technique used at the |
|---|
| 24 | 24 | | principal's discretion under Section 37.002(a) and the |
|---|
| 25 | 25 | | discretionary authority of a teacher to remove a disruptive student |
|---|
| 26 | 26 | | under Section 37.002(b). |
|---|
| 27 | 27 | | (b) Staff development training under this section may be |
|---|
| 28 | 28 | | provided in coordination with regional education service centers |
|---|
| 29 | 29 | | through the use of distance learning methods, such as |
|---|
| 30 | 30 | | telecommunications networks, and using available agency resources. |
|---|
| 31 | 31 | | SECTION 2. This Act applies beginning with the 2009-2010 |
|---|
| 32 | 32 | | school year. |
|---|
| 33 | 33 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2009. |
