55 relating to assessment of certain charges by certain commercial
66 landlords that are governmental entities.
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Section 93.012, Property Code, is amended by
99 adding Subsection (c) to read as follows:
1010 (c) This section does not affect the contractual right of a
1111 landlord that is a governmental entity created under Subchapter D,
1212 Chapter 22, Transportation Code, whose constituent municipalities
1313 are populous home-rule municipalities to assess charges under a
1414 lease to fully compensate the governmental entity for the
1515 governmental entity's operating costs.
1616 SECTION 2. This Act takes effect immediately if it receives
1717 a vote of two-thirds of all the members elected to each house, as
1818 provided by Section 39, Article III, Texas Constitution. If this
1919 Act does not receive the vote necessary for immediate effect, this
2020 Act takes effect September 1, 2009.
