| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Section 93.012, Property Code, is amended by |
|---|
| 9 | 9 | | adding Subsection (c) to read as follows: |
|---|
| 10 | 10 | | (c) This section does not affect the contractual right of a |
|---|
| 11 | 11 | | landlord that is a governmental entity created under Subchapter D, |
|---|
| 12 | 12 | | Chapter 22, Transportation Code, whose constituent municipalities |
|---|
| 13 | 13 | | are populous home-rule municipalities to assess charges under a |
|---|
| 14 | 14 | | lease to fully compensate the governmental entity for the |
|---|
| 15 | 15 | | governmental entity's operating costs. |
|---|
| 16 | 16 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 17 | 17 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 18 | 18 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 19 | 19 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 20 | 20 | | Act takes effect September 1, 2009. |
