55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the offenses of cruelty to livestock animals and
88 cruelty to nonlivestock animals.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 42.09(a) and (f), Penal Code, are
1111 amended to read as follows:
1212 (a) A person commits an offense if the person intentionally,
1313 [or] knowingly, or recklessly:
1414 (1) tortures a livestock animal;
1515 (2) fails unreasonably to provide necessary food,
1616 water, or care for a livestock animal in the person's custody;
1717 (3) abandons unreasonably a livestock animal in the
1818 person's custody;
1919 (4) transports or confines a livestock animal in a
2020 cruel and unusual manner;
2121 (5) without legal authority or the owner's effective
2222 consent, administers poison to or causes bodily injury to a
2323 livestock animal[, other than cattle, horses, sheep, swine, or
2424 goats, belonging to another without legal authority or the owner's
2525 effective consent];
2626 (6) trains, conditions, or causes one livestock animal
2727 to fight with another livestock animal or with an animal as defined
2828 by Section 42.092;
2929 (7) uses a live livestock animal as a lure in dog race
3030 training or in dog coursing on a racetrack;
3131 (8) trips a horse; or
3232 (9) seriously overworks a livestock animal.
3333 (f) It is a defense to prosecution under [an exception to
3434 the application of] this section that the conduct engaged in by the
3535 actor is a generally accepted and otherwise lawful:
3636 (1) form of conduct occurring solely for the purpose
3737 of or in support of:
3838 (A) fishing, hunting, or trapping; or
3939 (B) wildlife management, wildlife or depredation
4040 control, or shooting preserve practices as regulated by state and
4141 federal law; or
4242 (2) animal husbandry, ranching, or agriculture
4343 practice involving livestock animals.
4444 SECTION 2. Section 42.092(a)(2), Penal Code, is amended to
4545 read as follows:
4646 (2) "Animal" means a nonhuman mammal, bird, or captive
4747 amphibian or reptile [domesticated living creature, including any
4848 stray or feral cat or dog, and a wild living creature previously
4949 captured]. The term does not include [an uncaptured wild living
5050 creature or] a livestock animal.
5151 SECTION 3. Sections 42.092(b) and (f), Penal Code, are
5252 amended to read as follows:
5353 (b) A person commits an offense if the person intentionally,
5454 knowingly, or recklessly:
5555 (1) tortures an animal or in a cruel manner kills or
5656 causes serious bodily injury to an animal;
5757 (2) without the owner's effective consent, kills,
5858 administers poison to, or causes [serious] bodily injury to an
5959 animal;
6060 (3) fails unreasonably to provide necessary food,
6161 water, care, or shelter for an animal in the person's custody;
6262 (4) abandons unreasonably an animal in the person's
6363 custody;
6464 (5) transports or confines an animal in a cruel
6565 manner;
6666 (6) trains, conditions, or [without the owner's
6767 effective consent, causes bodily injury to an animal;
6868 [(7)] causes one animal to fight with another animal,
6969 if either animal is not a dog;
7070 (7) [(8)] uses a live animal as a lure in dog race
7171 training or in dog coursing on a racetrack; or
7272 (8) [(9)] seriously overworks an animal.
7373 (f) It is a defense to prosecution under [an exception to
7474 the application of] this section that the conduct engaged in by the
7575 actor is a generally accepted and otherwise lawful:
7676 (1) form of conduct occurring solely for the purpose
7777 of or in support of:
7878 (A) fishing, hunting, or trapping; or
7979 (B) wildlife management, wildlife or depredation
8080 control, or shooting preserve practices as regulated by state and
8181 federal law; [or]
8282 (2) animal husbandry or agriculture practice
8383 involving livestock animals; or
8484 (3) activity to control common household vermin or
8585 rodents.
8686 SECTION 4. The change in law made by this Act applies only
8787 to an offense committed on or after the effective date of this Act.
8888 An offense committed before the effective date of this Act is
8989 covered by the law in effect when the offense was committed, and the
9090 former law is continued in effect for that purpose. For purposes of
9191 this section, an offense was committed before the effective date of
9292 this Act if any element of the offense was committed before that
9393 date.
9494 SECTION 5. This Act takes effect September 1, 2009.
