A BILL TO BE ENTITLED
AN ACT
relating to the application of certain contract management laws to
the Texas Department of Transportation.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
SECTION 1. Section 2262.002, Government Code, is amended to
read as follows:
Sec. 2262.002. EXEMPTIONS. [(a)] This chapter does not
apply to an institution of higher education as defined by Section
61.003, Education Code.
[(b) This chapter does not apply to contracts of the Texas
Department of Transportation that:
[(1) relate to highway construction or highway
engineering; or
[(2) are subject to Section 201.112, Transportation
Code.]
SECTION 2. The change in law made by this Act applies only
to a contract by the Texas Department of Transportation for which
the solicitation of bids or proposals or similar expressions of
interest is published on or after September 1, 2009. A contract for
which the solicitation of bids or proposals or similar expressions
of interest is published before September 1, 2009, is governed by
the law in effect on the date the Texas Department of Transportation
first publishes the solicitation of bids or proposals or similar
expressions of interest, and the former law is continued in effect
for that purpose.
SECTION 3. This Act takes effect September 1, 2009.
