11 | 11 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
12 | 12 | SECTION 1. Section 683.071, Transportation Code, is amended | |
13 | 13 | to read as follows: | |
14 | 14 | Sec. 683.071. DEFINITION. In this subchapter, "junked | |
15 | 15 | vehicle" means a vehicle that is self-propelled and: | |
16 | 16 | (1) displays an expired license plate or invalid motor | |
17 | 17 | vehicle inspection certificate or does not display a license plate | |
18 | 18 | or motor vehicle inspection certificate; and [have lawfully | |
19 | 19 | attached to it: | |
20 | 20 | [(A) an unexpired license plate; and | |
21 | 21 | [(B) a valid motor vehicle inspection | |
22 | 22 | certificate; and] | |
23 | 23 | (2) is: | |
24 | 24 | (A) wrecked, dismantled or partially dismantled, | |
25 | 25 | or discarded; or | |
26 | 26 | (B) inoperable and has remained inoperable for | |
27 | 27 | more than: | |
28 | 28 | (i) 72 consecutive hours, if the vehicle is | |
29 | 29 | on public property; or | |
30 | 30 | (ii) 30 consecutive days, if the vehicle is | |
31 | 31 | on private property. | |
32 | 32 | SECTION 2. This Act takes effect September 1, 2009. |
