99 relating to the definition of a junked vehicle for purposes of
1010 abatement of a public nuisance.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 683.071, Transportation Code, is amended
1313 to read as follows:
1414 Sec. 683.071. DEFINITION. In this subchapter, "junked
1515 vehicle" means a vehicle that is self-propelled and:
1616 (1) displays an expired license plate or invalid motor
1717 vehicle inspection certificate or does not display a license plate
1818 or motor vehicle inspection certificate; and [have lawfully
1919 attached to it:
2020 [(A) an unexpired license plate; and
2121 [(B) a valid motor vehicle inspection
2222 certificate; and]
2323 (2) is:
2424 (A) wrecked, dismantled or partially dismantled,
2525 or discarded; or
2626 (B) inoperable and has remained inoperable for
2727 more than:
2828 (i) 72 consecutive hours, if the vehicle is
2929 on public property; or
3030 (ii) 30 consecutive days, if the vehicle is
3131 on private property.
3232 SECTION 2. This Act takes effect September 1, 2009.
