66 AN ACT
77 relating to state aid for certain juvenile justice alternative
88 education programs that enter into certain revenue sharing
99 agreements.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. (a) This section applies only to a juvenile
1212 justice alternative education program that:
1313 (1) is located in a county that has a population of
1414 less than 1.4 million and contains at least 12 school districts; and
1515 (2) for the 2005-2006 school year, received funding as
1616 a result of an agreement between school districts under Subchapter
1717 E, Chapter 41, Education Code.
1818 (b) To be entitled to state aid under this section, a
1919 juvenile justice alternative education program that received funds
2020 under an agreement under Subchapter E, Chapter 41, Education Code,
2121 for the 2005-2006 school year must attempt to enter into similar
2222 agreements for the 2009-2010 and 2010-2011 school years with each
2323 school district that participated in an agreement for the 2005-2006
2424 school year with the program.
2525 (c) A juvenile justice alternative education program is
2626 entitled to state aid under this section in an amount equal to:
2727 (1) for the 2009-2010 school year, the difference
2828 between:
2929 (A) the funding the program received as a result
3030 of all agreements between school districts under Subchapter E,
3131 Chapter 41, Education Code, for the 2005-2006 school year; and
3232 (B) the funding the program receives as a result
3333 of all agreements between school districts under Subchapter E,
3434 Chapter 41, Education Code, for the 2009-2010 school year; and
3535 (2) for the 2010-2011 school year, the difference
3636 between:
3737 (A) the funding the program received as a result
3838 of all agreements between school districts under Subchapter E,
3939 Chapter 41, Education Code, for the 2005-2006 school year; and
4040 (B) the funding the program receives as a result
4141 of all agreements between school districts under Subchapter E,
4242 Chapter 41, Education Code, for the 2010-2011 school year.
4343 (d) The commissioner of education shall:
4444 (1) determine the amount of state aid to which a
4545 juvenile justice alternative education program is entitled under
4646 this section; and
4747 (2) distribute the aid in 10 equal monthly
4848 installments:
4949 (A) for the 2009-2010 school year, beginning with
5050 September 2009 and ending with June 2010; and
5151 (B) for the 2010-2011 school year, beginning with
5252 September 2010 and ending with June 2011.
5353 (e) The commissioner of education shall adopt rules to
5454 implement this section.
5555 (f) A determination of the commissioner of education under
5656 this section is final and may not be appealed.
5757 SECTION 2. This Act takes effect September 1, 2009.
