7 | 7 | | relating to state aid for certain juvenile justice alternative |

8 | 8 | | education programs that enter into certain revenue sharing |

9 | 9 | | agreements. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. (a) This section applies only to a juvenile |
---|
12 | 12 | | justice alternative education program that: |
---|
13 | 13 | | (1) is located in a county that has a population of |
---|
14 | 14 | | less than 1.4 million and contains at least 12 school districts; and |
---|
15 | 15 | | (2) for the 2005-2006 school year, received funding as |
---|
16 | 16 | | a result of an agreement between school districts under Subchapter |
---|
17 | 17 | | E, Chapter 41, Education Code. |
---|
18 | 18 | | (b) To be entitled to state aid under this section, a |
---|
19 | 19 | | juvenile justice alternative education program that received funds |
---|
20 | 20 | | under an agreement under Subchapter E, Chapter 41, Education Code, |
---|
21 | 21 | | for the 2005-2006 school year must attempt to enter into similar |
---|
22 | 22 | | agreements for the 2009-2010 and 2010-2011 school years with each |
---|
23 | 23 | | school district that participated in an agreement for the 2005-2006 |
---|
24 | 24 | | school year with the program. |
---|
25 | 25 | | (c) A juvenile justice alternative education program is |
---|
26 | 26 | | entitled to state aid under this section in an amount equal to: |
---|
27 | 27 | | (1) for the 2009-2010 school year, the difference |
---|
28 | 28 | | between: |
---|
29 | 29 | | (A) the funding the program received as a result |
---|
30 | 30 | | of all agreements between school districts under Subchapter E, |
---|
31 | 31 | | Chapter 41, Education Code, for the 2005-2006 school year; and |
---|
32 | 32 | | (B) the funding the program receives as a result |
---|
33 | 33 | | of all agreements between school districts under Subchapter E, |
---|
34 | 34 | | Chapter 41, Education Code, for the 2009-2010 school year; and |
---|
35 | 35 | | (2) for the 2010-2011 school year, the difference |
---|
36 | 36 | | between: |
---|
37 | 37 | | (A) the funding the program received as a result |
---|
38 | 38 | | of all agreements between school districts under Subchapter E, |
---|
39 | 39 | | Chapter 41, Education Code, for the 2005-2006 school year; and |
---|
40 | 40 | | (B) the funding the program receives as a result |
---|
41 | 41 | | of all agreements between school districts under Subchapter E, |
---|
42 | 42 | | Chapter 41, Education Code, for the 2010-2011 school year. |
---|
43 | 43 | | (d) The commissioner of education shall: |
---|
44 | 44 | | (1) determine the amount of state aid to which a |
---|
45 | 45 | | juvenile justice alternative education program is entitled under |
---|
46 | 46 | | this section; and |
---|
47 | 47 | | (2) distribute the aid in 10 equal monthly |
---|
48 | 48 | | installments: |
---|
49 | 49 | | (A) for the 2009-2010 school year, beginning with |
---|
50 | 50 | | September 2009 and ending with June 2010; and |
---|
51 | 51 | | (B) for the 2010-2011 school year, beginning with |
---|
52 | 52 | | September 2010 and ending with June 2011. |
---|
53 | 53 | | (e) The commissioner of education shall adopt rules to |
---|
54 | 54 | | implement this section. |
---|
55 | 55 | | (f) A determination of the commissioner of education under |
---|
56 | 56 | | this section is final and may not be appealed. |
---|
57 | 57 | | SECTION 2. This Act takes effect September 1, 2009. |
