6	6	AN ACT
7	7	relating to the preparation of carbon dioxide emissions impact
8	8	statements for legislation pending before the legislature.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. The heading to Chapter 315, Government Code, is
11	11	amended to read as follows:
12	12	CHAPTER 315. IMPACT STATEMENTS REGARDING PENDING
13	13	LEGISLATION [ECONOMIC IMPACT STATEMENT]
14	14	SECTION 2. Sections 315.001 through 315.004, Government
15	15	Code, are designated as Subchapter A, Chapter 315, Government Code,
16	16	and a heading to that subchapter is added to read as follows:
17	17	SUBCHAPTER A. ECONOMIC IMPACT STATEMENT ACT
18	18	SECTION 3. Section 315.001, Government Code, is amended to
19	19	read as follows:
20	20	Sec. 315.001. SHORT TITLE. This subchapter [chapter] may
21	21	be cited as the Economic Impact Statement Act.
22	22	SECTION 4. Chapter 315, Government Code, is amended by
23	23	adding Subchapter B to read as follows:
24	24	SUBCHAPTER B. CARBON DIOXIDE EMISSIONS IMPACT STATEMENTS
25	25	Sec. 315.021. DEFINITION. In this subchapter, "joint
26	26	resolution" means a joint resolution proposing an amendment to the
27	27	Texas Constitution.
28	28	Sec. 315.022. PREPARATION OF STATEMENTS ON CARBON DIOXIDE
29	29	EMISSIONS IMPACT. (a) The Texas Commission on Environmental
30	30	Quality and the Legislative Budget Board jointly shall prepare for
31	31	each joint resolution or bill pending before the legislature in a
32	32	regular or special session, other than an appropriations bill, a
33	33	statement of the effect the proposed change in law would have, if
34	34	implemented, on the anthropogenic emissions of carbon dioxide in
35	35	this state.
36	36	(b) A statement prepared under this section must include:
37	37	(1) information on the category or categories of
38	38	sources of carbon dioxide emissions that would be affected by the
39	39	proposed change in law;
40	40	(2) information on the increases or decreases in
41	41	carbon dioxide emissions anticipated to result if the proposed
42	42	change in law is implemented, measured by units of weight; and
43	43	(3) any other information specified by a rule or
44	44	resolution adopted by the house of representatives or the senate.
45	45	Sec. 315.023. ASSISTANCE OF OTHER AGENCIES. Each board,
46	46	commission, office, or other agency in the executive or legislative
47	47	branch of state government shall provide the Texas Commission on
48	48	Environmental Quality or the Legislative Budget Board with any
49	49	information or assistance that the Texas Commission on
50	50	Environmental Quality or the Legislative Budget Board requests in
51	51	the preparation of a statement under Section 315.022.
52	52	Sec. 315.024. ATTACHMENT TO BILL OR JOINT RESOLUTION. (a)
53	53	A committee hearing on a bill or joint resolution introduced in a
54	54	regular or special session of the legislature may not be conducted
55	55	unless a statement prepared under Section 315.022 is first attached
56	56	to the bill or joint resolution.
57	57	(b) The statement must also be attached to the committee
58	58	report of the bill or joint resolution and to all subsequent
59	59	printings.
60	60	(c) The statement must remain with the bill or joint
61	61	resolution throughout the legislative process, including on
62	62	submission to the governor.
63	63	SECTION 5. The change in law made by this Act applies only
64	64	to a bill, other than an appropriations bill, or joint resolution to
65	65	amend the Texas Constitution that is introduced for consideration
66	66	by the legislature in a regular or special session that begins on or
67	67	after the effective date of this Act.
68	68	SECTION 6. This Act takes effect September 1, 2009.
