77 relating to the preparation of carbon dioxide emissions impact
88 statements for legislation pending before the legislature.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. The heading to Chapter 315, Government Code, is
1111 amended to read as follows:
1212 CHAPTER 315. IMPACT STATEMENTS REGARDING PENDING
1313 LEGISLATION [ECONOMIC IMPACT STATEMENT]
1414 SECTION 2. Sections 315.001 through 315.004, Government
1515 Code, are designated as Subchapter A, Chapter 315, Government Code,
1616 and a heading to that subchapter is added to read as follows:
1717 SUBCHAPTER A. ECONOMIC IMPACT STATEMENT ACT
1818 SECTION 3. Section 315.001, Government Code, is amended to
1919 read as follows:
2020 Sec. 315.001. SHORT TITLE. This subchapter [chapter] may
2121 be cited as the Economic Impact Statement Act.
2222 SECTION 4. Chapter 315, Government Code, is amended by
2323 adding Subchapter B to read as follows:
2424 SUBCHAPTER B. CARBON DIOXIDE EMISSIONS IMPACT STATEMENTS
2525 Sec. 315.021. DEFINITION. In this subchapter, "joint
2626 resolution" means a joint resolution proposing an amendment to the
2727 Texas Constitution.
2828 Sec. 315.022. PREPARATION OF STATEMENTS ON CARBON DIOXIDE
2929 EMISSIONS IMPACT. (a) The Texas Commission on Environmental
3030 Quality and the Legislative Budget Board jointly shall prepare for
3131 each joint resolution or bill pending before the legislature in a
3232 regular or special session, other than an appropriations bill, a
3333 statement of the effect the proposed change in law would have, if
3434 implemented, on the anthropogenic emissions of carbon dioxide in
3535 this state.
3636 (b) A statement prepared under this section must include:
3737 (1) information on the category or categories of
3838 sources of carbon dioxide emissions that would be affected by the
3939 proposed change in law;
4040 (2) information on the increases or decreases in
4141 carbon dioxide emissions anticipated to result if the proposed
4242 change in law is implemented, measured by units of weight; and
4343 (3) any other information specified by a rule or
4444 resolution adopted by the house of representatives or the senate.
4545 Sec. 315.023. ASSISTANCE OF OTHER AGENCIES. Each board,
4646 commission, office, or other agency in the executive or legislative
4747 branch of state government shall provide the Texas Commission on
4848 Environmental Quality or the Legislative Budget Board with any
4949 information or assistance that the Texas Commission on
5050 Environmental Quality or the Legislative Budget Board requests in
5151 the preparation of a statement under Section 315.022.
5252 Sec. 315.024. ATTACHMENT TO BILL OR JOINT RESOLUTION. (a)
5353 A committee hearing on a bill or joint resolution introduced in a
5454 regular or special session of the legislature may not be conducted
5555 unless a statement prepared under Section 315.022 is first attached
5656 to the bill or joint resolution.
5757 (b) The statement must also be attached to the committee
5858 report of the bill or joint resolution and to all subsequent
5959 printings.
6060 (c) The statement must remain with the bill or joint
6161 resolution throughout the legislative process, including on
6262 submission to the governor.
6363 SECTION 5. The change in law made by this Act applies only
6464 to a bill, other than an appropriations bill, or joint resolution to
6565 amend the Texas Constitution that is introduced for consideration
6666 by the legislature in a regular or special session that begins on or
6767 after the effective date of this Act.
6868 SECTION 6. This Act takes effect September 1, 2009.
