66 AN ACT
77 relating to the application of certain requirements affecting
88 certain subdivision golf courses.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 212.0155(a), Local Government Code, is
1111 amended to read as follows:
1212 (a) This section applies to land located wholly or partly in
1313 the corporate boundaries of a municipality if the municipality:
1414 (1) has a population of more than 50,000; and
1515 (2) is located wholly or partly in [a county]:
1616 (A) a county with a population of more than three
1717 million; [or]
1818 (B) a county with a population of more than
1919 275,000 that is adjacent to a county with a population of more than
2020 three million; or
2121 (C) a county with a population of more than 1.4
2222 million:
2323 (i) in which two or more municipalities
2424 with a population of 300,000 or more are located; and
2525 (ii) that is adjacent to a county with a
2626 population of more than two million.
2727 SECTION 2. (a) Notwithstanding Chapter 245, Local
2828 Government Code, the change in law made by Section 212.0155, Local
2929 Government Code, as amended by this Act, applies to approval of a
3030 plat filed on or after the effective date of this Act or before the
3131 effective date of this Act if the approval of a plat filed before
3232 the effective date of this Act is not final. A plat filed and
3333 approved before the effective date of this Act is governed by the
3434 law in effect immediately before that date, and that law is
3535 continued in effect for that purpose.
3636 (b) The change in law made by Section 212.0155, Local
3737 Government Code, as amended by this Act, does not apply to a lawsuit
3838 filed before the effective date of this Act. That section applies
3939 to land that is the subject of a lawsuit filed before the effective
4040 date of this Act on the date the decision in that lawsuit becomes
4141 final or the suit is otherwise terminated.
4242 SECTION 3. This Act takes effect immediately if it receives
4343 a vote of two-thirds of all the members elected to each house, as
4444 provided by Section 39, Article III, Texas Constitution. If this
4545 Act does not receive the vote necessary for immediate effect, this
4646 Act takes effect on the 91st day after the last day of the
4747 legislative session.
