| 7 | 7 | | relating to the application of certain requirements affecting |
|---|
| 8 | 8 | | certain subdivision golf courses. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 212.0155(a), Local Government Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (a) This section applies to land located wholly or partly in |
|---|
| 13 | 13 | | the corporate boundaries of a municipality if the municipality: |
|---|
| 14 | 14 | | (1) has a population of more than 50,000; and |
|---|
| 15 | 15 | | (2) is located wholly or partly in [a county]: |
|---|
| 16 | 16 | | (A) a county with a population of more than three |
|---|
| 17 | 17 | | million; [or] |
|---|
| 18 | 18 | | (B) a county with a population of more than |
|---|
| 19 | 19 | | 275,000 that is adjacent to a county with a population of more than |
|---|
| 20 | 20 | | three million; or |
|---|
| 21 | 21 | | (C) a county with a population of more than 1.4 |
|---|
| 22 | 22 | | million: |
|---|
| 23 | 23 | | (i) in which two or more municipalities |
|---|
| 24 | 24 | | with a population of 300,000 or more are located; and |
|---|
| 25 | 25 | | (ii) that is adjacent to a county with a |
|---|
| 26 | 26 | | population of more than two million. |

| 27 | 27 | | SECTION 2. (a) Notwithstanding Chapter 245, Local |
|---|
| 28 | 28 | | Government Code, the change in law made by Section 212.0155, Local |
|---|
| 29 | 29 | | Government Code, as amended by this Act, applies to approval of a |
|---|
| 30 | 30 | | plat filed on or after the effective date of this Act or before the |
|---|
| 31 | 31 | | effective date of this Act if the approval of a plat filed before |
|---|
| 32 | 32 | | the effective date of this Act is not final. A plat filed and |
|---|
| 33 | 33 | | approved before the effective date of this Act is governed by the |
|---|
| 34 | 34 | | law in effect immediately before that date, and that law is |
|---|
| 35 | 35 | | continued in effect for that purpose. |
|---|
| 36 | 36 | | (b) The change in law made by Section 212.0155, Local |
|---|
| 37 | 37 | | Government Code, as amended by this Act, does not apply to a lawsuit |
|---|
| 38 | 38 | | filed before the effective date of this Act. That section applies |
|---|
| 39 | 39 | | to land that is the subject of a lawsuit filed before the effective |
|---|
| 40 | 40 | | date of this Act on the date the decision in that lawsuit becomes |
|---|
| 41 | 41 | | final or the suit is otherwise terminated. |
|---|
| 42 | 42 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 43 | 43 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 44 | 44 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 45 | 45 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 46 | 46 | | Act takes effect on the 91st day after the last day of the |
|---|
| 47 | 47 | | legislative session. |
