| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 545.066(c), Transportation Code, is | |
| 10 | 10 | amended to read as follows: | |
| 11 | 11 | (c) An offense under this section is a misdemeanor | |
| 12 | 12 | punishable by a fine of not less than $200 or more than $500 | |
| 13 | 13 | [$1,000], except that the offense is: | |
| 14 | 14 | (1) a Class A misdemeanor if the person causes serious | |
| 15 | 15 | bodily injury to another; or | |
| 16 | 16 | (2) a state jail felony if the person has been | |
| 17 | 17 | previously convicted under Subdivision (1). | |
| 18 | 18 | SECTION 2. (a) The change in law made by this Act applies | |
| 19 | 19 | only to an offense committed on or after September 1, 2009. | |
| 20 | 20 | (b) An offense committed before September 1, 2009, is | |
| 21 | 21 | covered by the law in effect when the offense was committed, and the | |
| 22 | 22 | former law is continued in effect for that purpose. For purposes of | |
| 23 | 23 | this subsection, an offense was committed before September 1, 2009, | |
| 24 | 24 | if any element of the offense was committed before that date. | |
| 25 | 25 | SECTION 3. This Act takes effect September 1, 2009. |
