55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the penalty for illegally passing a stopped school bus.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 545.066(c), Transportation Code, is
1010 amended to read as follows:
1111 (c) An offense under this section is a misdemeanor
1212 punishable by a fine of not less than $200 or more than $500
1313 [$1,000], except that the offense is:
1414 (1) a Class A misdemeanor if the person causes serious
1515 bodily injury to another; or
1616 (2) a state jail felony if the person has been
1717 previously convicted under Subdivision (1).
1818 SECTION 2. (a) The change in law made by this Act applies
1919 only to an offense committed on or after September 1, 2009.
2020 (b) An offense committed before September 1, 2009, is
2121 covered by the law in effect when the offense was committed, and the
2222 former law is continued in effect for that purpose. For purposes of
2323 this subsection, an offense was committed before September 1, 2009,
2424 if any element of the offense was committed before that date.
2525 SECTION 3. This Act takes effect September 1, 2009.
