| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 61.013(d), Election Code, as added by | |
| 10 | 10 | Chapter 697 (H.B. 1921), Acts of the 80th Legislature, Regular | |
| 11 | 11 | Session, 2007, is amended to read as follows: | |
| 12 | 12 | (d) This section does not apply to: | |
| 13 | 13 | (1) an election officer in conducting the officer's | |
| 14 | 14 | official duties; [or] | |
| 15 | 15 | (2) the use of election equipment necessary for the | |
| 16 | 16 | conduct of the election; or | |
| 17 | 17 | (3) a person who is employed at the location in which a | |
| 18 | 18 | polling place is located while the person is acting in the course of | |
| 19 | 19 | the person's employment. | |
| 20 | 20 | SECTION 2. This Act takes effect immediately if it receives | |
| 21 | 21 | a vote of two-thirds of all the members elected to each house, as | |
| 22 | 22 | provided by Section 39, Article III, Texas Constitution. If this | |
| 23 | 23 | Act does not receive the vote necessary for immediate effect, this | |
| 24 | 24 | Act takes effect September 1, 2009. |
