7	7	relating to the participation of certain metropolitan planning
8	8	organization policy board members in votes of the board related to
9	9	certain toll projects.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter A, Chapter 371, Transportation Code,
12	12	as added by Chapter 103 (H.B. 570), Acts of the 80th Legislature,
13	13	Regular Session, 2007, is amended by adding Section 371.002 to read
14	14	as follows:
15	15	Sec. 371.002. METROPOLITAN PLANNING ORGANIZATION APPROVAL
16	16	OF TOLL PROJECTS. A member of the policy board of a metropolitan
17	17	planning organization may not participate in a vote of the board to
18	18	approve the construction of a new toll project or the conversion of
19	19	a nontolled project to a toll project unless the member is an
20	20	elected official.
21	21	SECTION 2. Subchapter A, Chapter 372, Transportation Code,
22	22	is amended by adding Section 372.002 to read as follows:
23	23	Sec. 372.002. METROPOLITAN PLANNING ORGANIZATION APPROVAL
24	24	OF TOLL PROJECTS. A member of the policy board of a metropolitan
25	25	planning organization may not participate in a vote of the board to
26	26	approve the construction of a new toll project or the conversion of
27	27	a nontolled project to a toll project unless the member is an
28	28	elected official.
29	29	SECTION 3. (a) Section 1 of this Act takes effect only if
30	30	the Act of the 81st Legislature, Regular Session, 2009, relating to
31	31	nonsubstantive additions to and corrections in existing codes does
32	32	not become law. If the Act of the 81st Legislature, Regular
33	33	Session, 2009, relating to nonsubstantive additions to and
34	34	corrections in existing codes becomes law, Section 1 of this Act has
35	35	no effect.
36	36	(b) Section 2 of this Act takes effect only if the Act of the
37	37	81st Legislature, Regular Session, 2009, relating to
38	38	nonsubstantive additions to and corrections in existing codes
39	39	becomes law. If the Act of the 81st Legislature, Regular Session,
40	40	2009, relating to nonsubstantive additions to and corrections in
41	41	existing codes does not become law, Section 2 of this Act has no
42	42	effect.
43	43	SECTION 4. This Act takes effect September 1, 2009.
