| 7 | 7 | | relating to certain exceptions to the prohibition on hunting from a |

| 8 | 8 | | public road or right-of-way. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 62.0031(b), Parks and Wildlife Code, is |
|---|
| 11 | 11 | | amended to read as follows: |
|---|
| 12 | 12 | | (b) This section does not apply to: |
|---|
| 13 | 13 | | (1) the trapping of a raptor for educational or |
|---|
| 14 | 14 | | sporting purposes as provided by Chapter 49; or |
|---|
| 15 | 15 | | (2) the capture, trapping, or hunting of a reptile, |
|---|
| 16 | 16 | | amphibian, or insect. |
|---|
| 17 | 17 | | SECTION 2. Conduct prohibited by Section 62.0031, Parks and |
|---|
| 18 | 18 | | Wildlife Code, that involves the capture, trapping, or hunting of a |
|---|
| 19 | 19 | | reptile, amphibian, or insect may not be prosecuted after the |
|---|
| 20 | 20 | | effective date of this Act. If on the effective date of this Act a |
|---|
| 21 | 21 | | criminal action is pending for conduct prohibited by Section |
|---|
| 22 | 22 | | 62.0031 and described by this section, the action is dismissed on |
|---|
| 23 | 23 | | that date. However, a final conviction for conduct prohibited by |
|---|
| 24 | 24 | | Section 62.0031 and described by this section that exists on the |
|---|
| 25 | 25 | | effective date of this Act is unaffected by this Act. |
|---|
| 26 | 26 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 27 | 27 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 28 | 28 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 29 | 29 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 30 | 30 | | Act takes effect September 1, 2009. |
