55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to providing for a student who qualifies for automatic
88 admission to an institution of higher education to maintain that
99 status for transferring between institutions in certain
1010 circumstances.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subchapter U, Chapter 51, Education Code, is
1313 amended by adding Section 51.8035 to read as follows:
1414 Sec. 51.8035. AUTOMATIC ADMISSION OF APPLICANTS COMPLETING
1515 CORE CURRICULUM AT ANOTHER INSTITUTION. (a) In this section:
1616 (1) "Core curriculum" means the core curriculum
1717 adopted by an institution of higher education under Section 61.822.
1818 (2) "Institution of higher education" has the meaning
1919 assigned by Section 61.003.
2020 (b) A general academic teaching institution shall admit an
2121 applicant for admission to the institution as a transfer
2222 undergraduate student who:
2323 (1) graduated from high school not earlier than the
2424 fourth school year before the academic year for which the applicant
2525 seeks admission and qualified for automatic admission to a general
2626 academic teaching institution under Section 51.803 at the time of
2727 graduation;
2828 (2) first enrolled in an institution of higher
2929 education not earlier than the second academic year before the
3030 academic year for which the applicant seeks admission;
3131 (3) completed the core curriculum at an institution of
3232 higher education, other than the institution to which the applicant
3333 seeks admission, with a cumulative grade point average of at least
3434 3.25 on a four-point scale or the equivalent; and
3535 (4) submits an application for admission as a transfer
3636 student before the expiration of any application filing deadline
3737 established by the institution.
3838 (c) For purposes of this section, transfer semester credit
3939 hours from a different institution of higher education and semester
4040 credit hours earned by examination shall be included in determining
4141 whether the person completed the core curriculum at an institution
4242 of higher education.
4343 SECTION 2. This Act applies beginning with admissions to a
4444 general academic teaching institution for the 2010 spring semester.
4545 SECTION 3. This Act takes effect immediately if it receives
4646 a vote of two-thirds of all the members elected to each house, as
4747 provided by Section 39, Article III, Texas Constitution. If this
4848 Act does not receive the vote necessary for immediate effect, this
4949 Act takes effect September 1, 2009.
