7 | 7 | | relating to prohibiting the manufacture and sale of certain |

8 | 8 | | children's products containing bisphenol-A or certain other |
---|
9 | 9 | | substances. |

10 | 10 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

11 | 11 | | SECTION 1. Subchapter B, Chapter 501, Health and Safety |
---|
12 | 12 | | Code, is amended by adding Section 501.0237 to read as follows: |
---|
13 | 13 | | Sec. 501.0237. BISPHENOL-A PROHIBITED IN CERTAIN PRODUCTS. |
---|
14 | 14 | | (a) In this section, "child's product" means: |
---|
15 | 15 | | (1) a toy designed or intended to be used for play by a |
---|
16 | 16 | | child younger than three years of age; |
---|
17 | 17 | | (2) cosmetics designed or intended to be used by a |
---|
18 | 18 | | child younger than three years of age; |
---|
19 | 19 | | (3) jewelry designed or intended for a child younger |
---|
20 | 20 | | than three years of age; or |
---|
21 | 21 | | (4) a product designed or intended for an infant or |
---|
22 | 22 | | child younger than three years of age to help with sucking or |
---|
23 | 23 | | teething or to facilitate sleep, relaxation, or feeding of the |
---|
24 | 24 | | infant or child. |
---|
25 | 25 | | (b) A person may not manufacture or sell a child's product |
---|
26 | 26 | | containing bisphenol-A. |
---|
27 | 27 | | (b-1) Notwithstanding Subsections (b), (c), and (d), a |
---|
28 | 28 | | person may manufacture or sell an infant formula container |
---|
29 | 29 | | containing bisphenol-A. This subsection expires January 1, 2013. |
---|
30 | 30 | | (c) A person may not manufacture or sell a child's product |
---|
31 | 31 | | containing any chemical that is: |
---|
32 | 32 | | (1) classified as "known to be a human carcinogen" or |
---|
33 | 33 | | "reasonably anticipated to be a human carcinogen" in the latest |
---|
34 | 34 | | Report on Carcinogens published by the National Toxicology Program |
---|
35 | 35 | | administered by the United States Department of Health and Human |
---|
36 | 36 | | Services; or |
---|
37 | 37 | | (2) identified by the United States Environmental |
---|
38 | 38 | | Protection Agency as causing birth defects, hormone disruption, or |
---|
39 | 39 | | harm to human reproduction or fetal development. |
---|
40 | 40 | | (d) A product described by Subsection (b) or (c) is a banned |
---|
41 | 41 | | hazardous substance for purposes of this chapter. |
---|
42 | 42 | | SECTION 2. This Act takes effect September 1, 2009. |
