| 7 | 7 | | relating to the service retirement annuity for certain members of |

| 8 | 8 | | the Judicial Retirement System of Texas Plan Two. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 839.102(a), Government Code, as amended |
|---|
| 11 | 11 | | by Chapters 1033 (H.B. 1114) and 1203 (H.B. 617), Acts of the 79th |
|---|
| 12 | 12 | | Legislature, Regular Session, 2005, is reenacted and amended to |
|---|
| 13 | 13 | | read as follows: |
|---|
| 14 | 14 | | (a) Except as provided by Subsections (b), (b-1), (c), (d), |
|---|
| 15 | 15 | | and (f), the standard service retirement annuity is an amount equal |
|---|
| 16 | 16 | | to 50 percent of the state salary being paid at the time the member |
|---|
| 17 | 17 | | retires to a judge of a court of the same classification as the last |
|---|
| 18 | 18 | | court to which the retiring member was elected or appointed. |
|---|
| 19 | 19 | | SECTION 2. Section 839.102, Government Code, is amended by |
|---|
| 20 | 20 | | adding Subsection (b-1) to read as follows: |
|---|
| 21 | 21 | | (b-1) The retirement system shall increase by 10 percent of |
|---|
| 22 | 22 | | the amount of the applicable state salary under Subsection (a), |
|---|
| 23 | 23 | | (b), or (c) the annuity of a member who on the effective date of |
|---|
| 24 | 24 | | retirement has continuously made contributions to the retirement |
|---|
| 25 | 25 | | system and has: |
|---|
| 26 | 26 | | (1) acquired at least 22 years of service credit as a |
|---|
| 27 | 27 | | district judge; or |
|---|
| 28 | 28 | | (2) acquired at least 20 years of service credit as an |
|---|
| 29 | 29 | | appellate judge. |
|---|
| 30 | 30 | | SECTION 3. The change in law made by this Act applies only |
|---|
| 31 | 31 | | to a person who retires on or after the effective date of this Act. |
|---|
| 32 | 32 | | The change in law does not apply to a person who retired before the |
|---|
| 33 | 33 | | effective date of this Act. |
|---|
| 34 | 34 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 35 | 35 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 36 | 36 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 37 | 37 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 38 | 38 | | Act takes effect September 1, 2009. |
