55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the service retirement annuity for certain members of
88 the Judicial Retirement System of Texas Plan Two.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 839.102(a), Government Code, as amended
1111 by Chapters 1033 (H.B. 1114) and 1203 (H.B. 617), Acts of the 79th
1212 Legislature, Regular Session, 2005, is reenacted and amended to
1313 read as follows:
1414 (a) Except as provided by Subsections (b), (b-1), (c), (d),
1515 and (f), the standard service retirement annuity is an amount equal
1616 to 50 percent of the state salary being paid at the time the member
1717 retires to a judge of a court of the same classification as the last
1818 court to which the retiring member was elected or appointed.
1919 SECTION 2. Section 839.102, Government Code, is amended by
2020 adding Subsection (b-1) to read as follows:
2121 (b-1) The retirement system shall increase by 10 percent of
2222 the amount of the applicable state salary under Subsection (a),
2323 (b), or (c) the annuity of a member who on the effective date of
2424 retirement has continuously made contributions to the retirement
2525 system and has:
2626 (1) acquired at least 22 years of service credit as a
2727 district judge; or
2828 (2) acquired at least 20 years of service credit as an
2929 appellate judge.
3030 SECTION 3. The change in law made by this Act applies only
3131 to a person who retires on or after the effective date of this Act.
3232 The change in law does not apply to a person who retired before the
3333 effective date of this Act.
3434 SECTION 4. This Act takes effect immediately if it receives
3535 a vote of two-thirds of all the members elected to each house, as
3636 provided by Section 39, Article III, Texas Constitution. If this
3737 Act does not receive the vote necessary for immediate effect, this
3838 Act takes effect September 1, 2009.
