55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to social security coverage for employees of public school
88 districts.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. (a) Not later than December 31, 2009, each
1111 public school district in this state not currently participating in
1212 an agreement under Subchapter B, Chapter 606, Government Code, to
1313 provide social security coverage to all of the employees of the
1414 district, shall conduct a referendum by secret ballot of the
1515 employees of the district, as required by Section 218, Social
1616 Security Act (42 U.S.C. Section 418), to determine whether a
1717 majority of the employees are in favor of being included in the
1818 agreement of this state with the commissioner of the Social
1919 Security Administration or the individual designated by the
2020 commissioner to administer coverage of the Social Security Act to
2121 employees of a state and its political subdivisions.
2222 (b) If a majority of the employees of a school district vote
2323 in favor of entering into the agreement to provide social security
2424 coverage, the board of trustees of the school district shall as soon
2525 as practicable submit the necessary plan to the state social
2626 security administrator to effect the participation of the school
2727 district under Subchapter B, Chapter 606, Government Code.
2828 SECTION 2. This Act expires January 1, 2011.
2929 SECTION 3. This Act takes effect immediately if it receives
3030 a vote of two-thirds of all the members elected to each house, as
3131 provided by Section 39, Article III, Texas Constitution. If this
3232 Act does not receive the vote necessary for immediate effect, this
3333 Act takes effect September 1, 2009.
