| 7 | 7 | | relating to social security coverage for employees of public school |

| 8 | 8 | | districts. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. (a) Not later than December 31, 2009, each |
|---|
| 11 | 11 | | public school district in this state not currently participating in |
|---|
| 12 | 12 | | an agreement under Subchapter B, Chapter 606, Government Code, to |
|---|
| 13 | 13 | | provide social security coverage to all of the employees of the |
|---|
| 14 | 14 | | district, shall conduct a referendum by secret ballot of the |
|---|
| 15 | 15 | | employees of the district, as required by Section 218, Social |
|---|
| 16 | 16 | | Security Act (42 U.S.C. Section 418), to determine whether a |
|---|
| 17 | 17 | | majority of the employees are in favor of being included in the |
|---|
| 18 | 18 | | agreement of this state with the commissioner of the Social |
|---|
| 19 | 19 | | Security Administration or the individual designated by the |
|---|
| 20 | 20 | | commissioner to administer coverage of the Social Security Act to |
|---|
| 21 | 21 | | employees of a state and its political subdivisions. |
|---|
| 22 | 22 | | (b) If a majority of the employees of a school district vote |
|---|
| 23 | 23 | | in favor of entering into the agreement to provide social security |
|---|
| 24 | 24 | | coverage, the board of trustees of the school district shall as soon |
|---|
| 25 | 25 | | as practicable submit the necessary plan to the state social |
|---|
| 26 | 26 | | security administrator to effect the participation of the school |
|---|
| 27 | 27 | | district under Subchapter B, Chapter 606, Government Code. |
|---|
| 28 | 28 | | SECTION 2. This Act expires January 1, 2011. |
|---|
| 29 | 29 | | SECTION 3. This Act takes effect immediately if it receives |
|---|
| 30 | 30 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 31 | 31 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 32 | 32 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 33 | 33 | | Act takes effect September 1, 2009. |
