99 relating to the development of a climate adaptation plan by certain
1010 entities.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Subtitle C, Title 5, Health and Safety Code, is
1313 amended by adding Chapter 393 to read as follows:
1414 CHAPTER 393. CLIMATE ADAPTATION PLAN
1515 Sec. 393.001. PARTICIPATING ENTITIES. Not later than
1616 September 1 of each even-numbered year, each of the following
1717 entities shall publish a climate adaptation plan that will assess
1818 the entity's role with respect to climate change:
1919 (1) the Department of Agriculture;
2020 (2) the independent organization certified under
2121 Section 39.151, Utilities Code;
2222 (3) the Texas Commission on Environmental Quality;
2323 (4) the General Land Office;
2424 (5) the Health and Human Services Commission;
2525 (6) the Texas Department of Housing and Community
2626 Affairs;
2727 (7) the Texas Department of Insurance;
2828 (8) the Parks and Wildlife Department;
2929 (9) the Department of Public Safety of the State of
3030 Texas;
3131 (10) the Public Utility Commission of Texas;
3232 (11) the office of the comptroller;
3333 (12) the Texas Department of Transportation;
3434 (13) the Texas Forest Service; and
3535 (14) the Texas Water Development Board.
3636 Sec. 393.002. PLAN. (a) For the purposes of this chapter,
3737 a climate adaptation plan is a strategy to identify, minimize, and
3838 adequately prepare for the effects of global warming on the social,
3939 economic, and ecological systems of this state and to manage the
4040 risks associated with a changing climate. A plan under this section
4141 must be based on current research-based climate science that
4242 identifies the likely impacts of rising ambient temperatures on
4343 this state.
4444 (b) Each climate adaptation plan must include:
4545 (1) a climate change vulnerability assessment;
4646 (2) a review of existing programs in the context of
4747 anticipated changing climate conditions;
4848 (3) specific steps necessary for the entity to fulfill
4949 its mission during the anticipated climate change;
5050 (4) an analysis of the effects implementing the steps
5151 identified under Subdivision (3) would have on the entity's budget
5252 during the next 2, 5, and 10 years;
5353 (5) potential sources of funding to support the
5454 entity's efforts to adapt to climate change; and
5555 (6) a statewide strategy to monitor the continuing
5656 effects of climate change.
5757 (c) In developing a climate adaptation plan, each entity
5858 subject to this section shall:
5959 (1) consider the most current assessment reports
6060 created by the Intergovernmental Panel on Climate Change;
6161 (2) consult with the Houston Advanced Research Center;
6262 and
6363 (3) consult with the Office of the Texas State
6464 Climatologist in the Department of Atmospheric Sciences, College of
6565 Geosciences, Texas A&M University.
6666 (d) Not later than September 1 of each even-numbered year,
6767 each entity subject to this section shall post the entity's climate
6868 adaptation plan on a publicly accessible Internet website and
6969 electronically submit a copy of the plan to:
7070 (1) the governor, lieutenant governor, and speaker of
7171 the house of representatives;
7272 (2) the presiding officer of each standing committee
7373 or subcommittee of the legislature with primary jurisdiction over
7474 environmental matters; and
7575 (3) the executive director of the Texas Commission on
7676 Environmental Quality.
7777 (e) Each climate adaptation plan is subject to audit by the
7878 state auditor in accordance with Chapter 321, Government Code.
7979 SECTION 2. This Act takes effect immediately if it receives
8080 a vote of two-thirds of all the members elected to each house, as
8181 provided by Section 39, Article III, Texas Constitution. If this
8282 Act does not receive the vote necessary for immediate effect, this
8383 Act takes effect September 1, 2009.
