66 AN ACT
77 relating to monetary assistance for substitute care provided to a
88 child by a relative caregiver.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 264.755, Family Code, is amended by
1111 amending Subsection (a) and adding Subsection (d) to read as
1212 follows:
1313 (a) The department shall[, subject to the availability of
1414 funds,] enter into a caregiver assistance agreement with each
1515 relative or other designated caregiver to provide monetary
1616 assistance and additional support services to the caregiver.
1717 Subject to Subsection (d), the [The] monetary assistance and
1818 support services shall be based on a family's need, as determined by
1919 rules adopted by the executive commissioner, and be subject to the
2020 availability of funds.
2121 (d) A caregiver assistance agreement entered into under
2222 this section between the department and a relative caregiver who
2323 will provide substitute care for a child for whom the department has
2424 been appointed managing conservator must require the department to
2525 pay monetary assistance to the relative caregiver during the time
2626 the child is in substitute care. The monetary assistance must be
2727 paid at a daily rate that is equal to the daily 24-hour residential
2828 child-care rate that the department would pay for the child if the
2929 substitute care were provided in a foster home, foster group home,
3030 agency foster home, or agency foster group home licensed or
3131 certified under Chapter 42, Human Resources Code, and the child
3232 were assigned a basic service level.
3333 SECTION 2. The change in law made by this Act applies to a
3434 caregiver assistance agreement entered into on or after the
3535 effective date of this Act. A caregiver assistance agreement
3636 entered into before the effective date of this Act is governed by
3737 the law in effect on the date the agreement was entered into, and
3838 the former law is continued in effect for that purpose.
3939 SECTION 3. This Act takes effect September 1, 2009.
