55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to abstinence education in public schools.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 28.004, Education Code, is amended by
1010 amending Subsections (e) and (g) and adding Subsection (m) to read
1111 as follows:
1212 (e) Any course materials and instruction relating to human
1313 sexuality, sexually transmitted diseases, or human
1414 immunodeficiency virus or acquired immune deficiency syndrome
1515 shall be selected by the board of trustees with the advice of the
1616 local school health advisory council and must:
1717 (1) present abstinence from sexual activity as the
1818 healthiest [preferred] choice of behavior [in relationship to all
1919 sexual activity] for unmarried persons of school age;
2020 (2) devote more attention to abstinence from sexual
2121 activity than to any other behavior;
2222 (3) emphasize that abstinence from sexual activity, if
2323 used consistently and correctly, is the only certain way to prevent
2424 [method that is 100 percent effective in preventing] pregnancy and
2525 [,] sexually transmitted diseases, including [infection with]
2626 human immunodeficiency virus and [or] acquired immune deficiency
2727 syndrome, and the emotional trauma that may be associated with
2828 adolescent sexual activity;
2929 (4) include only scientifically accurate information
3030 about the effectiveness of contraceptives and methods of reducing
3131 the risk of sexually transmitted diseases and teach contraception
3232 in terms of typical use rates, if instruction on contraception is
3333 included in the curriculum content [direct adolescents to a
3434 standard of behavior in which abstinence from sexual activity
3535 before marriage is the most effective way to prevent pregnancy,
3636 sexually transmitted diseases, and infection with human
3737 immunodeficiency virus or acquired immune deficiency syndrome];
3838 and
3939 (5) not discourage the use by students who are
4040 sexually active of any form of contraception or method approved by
4141 the United States Food and Drug Administration of reducing the risk
4242 of transmission of sexually transmitted diseases [teach
4343 contraception and condom use in terms of human use reality rates
4444 instead of theoretical laboratory rates, if instruction on
4545 contraception and condoms is included in curriculum content].
4646 (g) A school district that provides human sexuality
4747 instruction may separate students according to gender [sex] for
4848 instructional purposes.
4949 (m) In this section:
5050 (1) "Scientifically accurate information" means
5151 information that is:
5252 (A) verified or supported by research conducted
5353 in compliance with scientific methods;
5454 (B) published in peer reviewed journals, if
5555 appropriate; and
5656 (C) recognized as accurate and objective by
5757 professional organizations and agencies with expertise in the
5858 relevant field, including:
5959 (i) the Centers for Disease Control and
6060 Prevention;
6161 (ii) the American Public Health
6262 Association;
6363 (iii) the Society for Adolescent Medicine;
6464 (iv) the American Academy of Pediatrics;
6565 and
6666 (v) the American College of Obstetricians
6767 and Gynecologists.
6868 (2) "Typical use rate" means the rate of failure for a
6969 method of contraception when that method is not used by a person for
7070 each act of sexual intercourse or when that method is not used by a
7171 person for each act according to the instructions for that method.
7272 The rate is identical to the rate defined as the typical use rate by
7373 the United States Food and Drug Administration.
7474 SECTION 2. This Act applies beginning with the 2009-2010
7575 school year.
7676 SECTION 3. This Act takes effect immediately if it receives
7777 a vote of two-thirds of all the members elected to each house, as
7878 provided by Section 39, Article III, Texas Constitution. If this
7979 Act does not receive the vote necessary for immediate effect, this
8080 Act takes effect September 1, 2009.
