| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Chapter 63, Election Code, is amended by adding | |
| 11 | 11 | Section 63.0091 to read as follows: | |
| 12 | 12 | Sec. 63.0091. REGISTRATION AT POLLING PLACE; VOTING | |
| 13 | 13 | PROCEDURES. (a) This section applies to the conduct of voting and | |
| 14 | 14 | to the registration of voters notwithstanding and in addition to | |
| 15 | 15 | other applicable provisions of this code. | |
| 16 | 16 | (b) A person who would be eligible to vote in an election | |
| 17 | 17 | under Section 11.001, but for the requirement to be a registered | |
| 18 | 18 | voter, shall be accepted for voting in the precinct of the person's | |
| 19 | 19 | residence if, on the day the person offers to vote, the person: | |
| 20 | 20 | (1) submits a voter registration application that | |
| 21 | 21 | complies with Section 13.002; and | |
| 22 | 22 | (2) presents proof of identification in a form | |
| 23 | 23 | described by Section 63.0101 that also establishes the person's | |
| 24 | 24 | residence. | |
| 25 | 25 | (c) Persons voting under this section shall be processed | |
| 26 | 26 | separately at the polling place from persons who are voting under | |
| 27 | 27 | regular procedures. | |
| 28 | 28 | (d) The secretary of state shall prescribe the procedures | |
| 29 | 29 | necessary to implement this section and to ensure the proper and | |
| 30 | 30 | orderly conduct of elections. | |
| 31 | 31 | SECTION 2. This Act takes effect September 1, 2009. |
