| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 92.0563, Property Code, is amended by | |
| 11 | 11 | amending Subsection (c) and adding Subsection (d) to read as | |
| 12 | 12 | follows: | |
| 13 | 13 | (c) The justice, county, and district courts have | |
| 14 | 14 | concurrent jurisdiction in [of] an action under Subsection (a) [of | |
| 15 | 15 | this section except that the justice court may not order repairs | |
| 16 | 16 | under Subdivision (1) of Subsection (a) of this section]. | |
| 17 | 17 | (d) If a suit is filed in a justice court requesting relief | |
| 18 | 18 | under Subsection (a), the justice court shall conduct a hearing on | |
| 19 | 19 | the request not earlier than the sixth day after the date on which | |
| 20 | 20 | the action is filed and not later than the 10th day after that date. | |
| 21 | 21 | SECTION 2. The change in law made by this Act applies only | |
| 22 | 22 | to an action filed on or after the effective date of this Act. An | |
| 23 | 23 | action filed before the effective date of this Act is governed by | |
| 24 | 24 | the law in effect immediately before that date, and that law is | |
| 25 | 25 | continued in effect for that purpose. | |
| 26 | 26 | SECTION 3. This Act takes effect January 1, 2010. |
