66 AN ACT
77 relating to a study regarding the establishment and administration
88 of a legislative youth advisory council in this state.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter A, Chapter 67, Education Code, is
1111 amended by adding Section 67.04 to read as follows:
1212 Sec. 67.04. STUDY REGARDING ESTABLISHMENT AND
1313 ADMINISTRATION OF LEGISLATIVE YOUTH ADVISORY COUNCIL. (a) In this
1414 section:
1515 (1) "School" means The University of Texas Lyndon B.
1616 Johnson School of Public Affairs.
1717 (2) "Youth council" means a legislative youth advisory
1818 council.
1919 (b) The University of Texas Lyndon B. Johnson School of
2020 Public Affairs shall conduct a study regarding the establishment
2121 and administration of a legislative youth advisory council in this
2222 state for the purpose of:
2323 (1) engaging young Texans in:
2424 (A) identifying, evaluating, and prioritizing
2525 policy issues affecting youth, including policy issues relating to
2626 education, employment, substance abuse and underage drinking,
2727 physical and emotional health, poverty, safety, the environment,
2828 driver's licenses, and strategies to increase youth participation
2929 in local and state government and youth access to local and state
3030 governmental services; and
3131 (B) developing recommendations for legislation
3232 to address policy issues affecting youth; and
3333 (2) facilitating communication between young Texans
3434 and members of the legislature regarding policy issues and proposed
3535 legislation affecting youth.
3636 (c) As a part of its study, the school shall:
3737 (1) examine the composition, terms of office,
3838 membership eligibility requirements, membership application and
3939 selection process, activities, and administration of councils or
4040 other entities established by other states for similar purposes to
4141 determine whether any of those entities is an appropriate model for
4242 a youth council in this state;
4343 (2) develop an estimate of the expenses that would be
4444 associated with establishing and administering a youth council in
4545 this state;
4646 (3) identify potential funding sources for the
4747 expenses described by Subdivision (2);
4848 (4) develop recommendations for:
4949 (A) the composition, terms of office, membership
5050 eligibility requirements, membership application and selection
5151 process, activities, and administration of a youth council in this
5252 state; and
5353 (B) the governmental or other entity or entities
5454 that are best positioned to support and administer a youth council
5555 in this state; and
5656 (5) consider any other issues the school considers
5757 appropriate regarding the establishment and administration of a
5858 youth council in this state.
5959 (d) In developing its recommendations for the composition
6060 of a youth council, the school shall consider the feasibility of
6161 establishing a youth council that:
6262 (1) reflects the diversity of youth across this state;
6363 and
6464 (2) is composed of:
6565 (A) a specific number of youth members from each
6666 state senate district; and
6767 (B) nonvoting advisory members who are members of
6868 the Texas Legislature or those members' designees.
6969 (e) The comptroller and the Legislative Budget Board shall
7070 assist the school in developing cost estimates for implementing the
7171 school's recommendations for the establishment and administration
7272 of a youth council in this state.
7373 (f) Not later than October 1, 2010, the school shall submit
7474 to the legislature a written report detailing the school's findings
7575 and recommendations regarding the establishment and administration
7676 of a youth council in this state. The report must include the cost
7777 estimates for implementing the school's recommendations developed
7878 under Subsection (e).
7979 (g) This section expires September 1, 2011.
8080 SECTION 2. This Act takes effect immediately if it receives
8181 a vote of two-thirds of all the members elected to each house, as
8282 provided by Section 39, Article III, Texas Constitution. If this
8383 Act does not receive the vote necessary for immediate effect, this
8484 Act takes effect September 1, 2009.
