9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
10 | 10 | SECTION 1. Section 28.002, Education Code, is amended by | |
11 | 11 | adding Subsection (q) to read as follows: | |
12 | 12 | (q) In addition to the daily physical activity requirement | |
13 | 13 | prescribed by Subsection (l), a school district shall require a | |
14 | 14 | student enrolled in elementary school to participate in | |
15 | 15 | unstructured and undirected play for at least 20 minutes each | |
16 | 16 | school day throughout the school year. In implementing this | |
17 | 17 | subsection, the district shall consider the recommendations | |
18 | 18 | provided under Section 28.004(l) by the local school health | |
19 | 19 | advisory council. | |
20 | 20 | SECTION 2. This Act applies beginning with the 2009-2010 | |
21 | 21 | school year. | |
22 | 22 | SECTION 3. This Act takes effect immediately if it receives | |
23 | 23 | a vote of two-thirds of all the members elected to each house, as | |
24 | 24 | provided by Section 39, Article III, Texas Constitution. If this | |
25 | 25 | Act does not receive the vote necessary for immediate effect, this | |
26 | 26 | Act takes effect September 1, 2009. |
