10	10	AN ACT
11	11	relating to a documented member of the Kickapoo Traditional Tribe
12	12	of Texas hunting certain deer.
13	13	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
14	14	SECTION 1. Section 42.001(1), Parks and Wildlife Code, is
15	15	amended to read as follows:
16	16	(1) "Resident" means:
17	17	(A) an individual who has resided continuously in
18	18	this state for more than six months immediately before applying for
19	19	a hunting license;
20	20	(B) a member of the United States armed forces on
21	21	active duty;
22	22	(C) a dependent of a member of the United States
23	23	armed forces on active duty; [or]
24	24	(D) a member of any other category of individuals
25	25	that the commission by regulation designates as residents; or
26	26	(E) a member of the Kickapoo Traditional Tribe of
27	27	Texas who possesses documentation of membership sanctioned by the
28	28	Bureau of Indian Affairs.
29	29	SECTION 2. Section 61.021, Parks and Wildlife Code, is
30	30	amended to read as follows:
31	31	Sec. 61.021. TAKING WILDLIFE RESOURCES PROHIBITED. (a)
32	32	Except as provided by Subsection (b) or permitted under a
33	33	proclamation issued by the commission under this chapter, no person
34	34	may hunt, catch, or possess a game bird or game animal, fish, marine
35	35	animal, or other aquatic life at any time or in any place covered by
36	36	this chapter.
37	37	(b) A documented member of the Kickapoo Traditional Tribe of
38	38	Texas who holds a license under Section 42.002 may hunt antlerless
39	39	white-tailed deer for religious ceremonial purposes on any day of
40	40	the year between one-half hour before sunrise and one-half hour
41	41	after sunset. A documented member of the Kickapoo Traditional
42	42	Tribe of Texas hunting antlerless white-tailed deer under this
43	43	subsection shall:
44	44	(1) comply with all other provisions of this code and
45	45	proclamations adopted under this code;
46	46	(2) notify a local game warden, deputy game warden, or
47	47	special game warden at least 24 hours before hunting antlerless
48	48	white-tailed deer during an otherwise closed season under the game
49	49	laws of this state; and
50	50	(3) obtain explicit permission from the landowner
51	51	before hunting antlerless white-tailed deer during an otherwise
52	52	closed season under the game laws of this state on that landowner's
53	53	privately owned property.
54	54	SECTION 3. Section 61.057(a), Parks and Wildlife Code, is
55	55	amended to read as follows:
56	56	(a) Except as provided by Section 61.021 and [in] Subsection
57	57	(c) [of this section], no person may hunt an antlerless deer or
58	58	antelope in this state without first having acquired an antlerless
59	59	deer or antelope permit issued by the department on a form provided
60	60	by the department.
61	61	SECTION 4. This Act takes effect immediately if it receives
62	62	a vote of two-thirds of all the members elected to each house, as
63	63	provided by Section 39, Article III, Texas Constitution. If this
64	64	Act does not receive the vote necessary for immediate effect, this
65	65	Act takes effect September 1, 2009.
