66 AN ACT
77 relating to restrictions on the purchase of certain regulated
88 metals by metal recycling entities; providing a criminal penalty.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 1956.001(10), Occupations Code, is
1111 amended to read as follows:
1212 (10) "Regulated metal" means:
1313 (A) manhole covers;
1414 (B) guardrails;
1515 (C) metal cylinders designed to contain
1616 compressed air, oxygen, gases, or liquids;
1717 (D) beer kegs made from metal other than
1818 aluminum;
1919 (E) historical markers or cemetery vases,
2020 receptacles, or memorials made from metal other than aluminum;
2121 (F) unused rebar;
2222 (G) street signs;
2323 (H) drain gates;
2424 (I) safes;
2525 (J) communication, transmission, and service
2626 wire or cable;
2727 (K) condensing or evaporator coils for heating or
2828 air conditioning units;
2929 (L) utility structures, including the fixtures
3030 and hardware;
3131 (M) aluminum or stainless steel containers
3232 designed to hold propane for fueling forklifts; [and]
3333 (N) metal railroad equipment, including tie
3434 plates, signal houses, control boxes, signs, signals, traffic
3535 devices, traffic control devices, traffic control signals, switch
3636 plates, e-clips, and rail tie functions; and
3737 (O) catalytic converters.
3838 SECTION 2. Sections 1956.032(d) and (e), Occupations Code,
3939 are amended to read as follows:
4040 (d) The metal recycling entity or the entity's agent for
4141 recordkeeping purposes may [photograph the seller's entire face,
4242 not including any hat, and] obtain the name of the seller's
4343 employer.
4444 (e) At the time of purchase of the regulated material, the
4545 [The] metal recycling entity or the entity's agent for
4646 recordkeeping purposes shall:
4747 (1) [may] take a clear digital still photograph of:
4848 (A) the motor vehicle and any trailer attached to
4949 the motor vehicle of the seller in which the make, model, and
5050 license plate number of the motor vehicle and trailer are
5151 identifiable;
5252 (B) the regulated material being purchased; and
5353 (C) the seller that clearly depicts the seller's
5454 facial features; and
5555 (2) take a clear and legible thumbprint impression of
5656 the seller [in lieu of the information required under Subsection
5757 (a)(3)].
5858 SECTION 3. Sections 1956.036(a) and (b), Occupations Code,
5959 are amended to read as follows:
6060 (a) Except as provided by Subsection (b), not later than the
6161 seventh day after the date of the purchase or other acquisition of
6262 material for which a record is required under Section 1956.033, a
6363 metal recycling entity shall electronically submit [send by
6464 facsimile or electronic mail] to [or file with] the department a
6565 report containing the information required to be recorded under
6666 that section.
6767 (b) If a metal recycling entity purchases bronze material
6868 that is a cemetery vase, receptacle, memorial, or statuary or a pipe
6969 that can reasonably be identified as aluminum irrigation pipe, the
7070 entity shall:
7171 (1) not later than the close of business on the
7272 entity's first working day after the purchase date, notify the
7373 department; and
7474 (2) not later than the fifth day after the purchase
7575 date, electronically submit [mail] to [or file with] the department
7676 a report containing the information required to be recorded under
7777 Section 1956.033.
7878 SECTION 4. Section 1956.037, Occupations Code, is amended
7979 by amending Subsection (a) and adding Subsection (a-1) to read as
8080 follows:
8181 (a) A metal recycling entity may not dispose of, process,
8282 sell, or remove from the premises an item of regulated metal unless:
8383 (1) the entity acquired the item more than five days
8484 [72 hours], excluding weekends and holidays, before the date of the
8585 disposal, processing, sale, or removal; or
8686 (2) the entity purchased the item from a
8787 manufacturing, industrial, commercial, retail, or other seller
8888 that sells regulated material in the ordinary course of its
8989 business.
9090 (a-1) Notwithstanding Subsection (a), a metal recycling
9191 entity may not dispose of material for which a record is required
9292 under Section 1956.033 until the entity has submitted the report
9393 required by Section 1956.036.
9494 SECTION 5. Section 1956.040, Occupations Code, is amended
9595 by adding Subsection (f) to read as follows:
9696 (f) A person commits an offense if the person violates
9797 Section 1956.021. An offense under this subsection is a state jail
9898 felony.
9999 SECTION 6. The changes in law made by this Act by the
100100 amendment of Sections 1956.036(a) and (b), Occupations Code, apply
101101 only to a report required to be submitted to the Department of
102102 Public Safety on or after January 1, 2010. A report required to be
103103 submitted before January 1, 2010, is governed by the law in effect
104104 on the date the report is required to be submitted, and the former
105105 law is continued in effect for that purpose.
106106 SECTION 7. This Act takes effect September 1, 2009.
