99 relating to the exemption from certain construction requirements
1010 for volunteer fire departments in certain counties.
1111 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1212 SECTION 1. Section 1001.407, Occupations Code, is amended
1313 to read as follows:
1414 Sec. 1001.407. CONSTRUCTION OF CERTAIN PUBLIC WORKS. (a)
1515 Except as provided by Subsection (b), this [The] state or a
1616 political subdivision of this [the] state may not construct a
1717 public work involving engineering in which the public health,
1818 welfare, or safety is involved, unless:
1919 (1) the engineering plans, specifications, and
2020 estimates have been prepared by an engineer; and
2121 (2) the engineering construction is to be performed
2222 under the direct supervision of an engineer.
2323 (b) This section does not apply to a building or other
2424 facility that:
2525 (1) is occupied exclusively by a volunteer fire
2626 department, as defined by Section 152.001, Tax Code, in a county
2727 with a population of 80,000 or less;
2828 (2) is not routinely used by the public;
2929 (3) is approved by an engineer, which shall include an
3030 approval evidenced by an engineer stamp on a plan or document for a
3131 prefabricated building; and
3232 (4) has a slab that is approved by an engineer for the
3333 specific building approved under Subdivision (3), which shall
3434 include an approval evidenced by an engineer stamp on a plan or
3535 document of the slab's intended purpose.
3636 SECTION 2. This Act takes effect immediately if it receives
3737 a vote of two-thirds of all the members elected to each house, as
3838 provided by Section 39, Article III, Texas Constitution. If this
3939 Act does not receive the vote necessary for immediate effect, this
4040 Act takes effect September 1, 2009.
