| 7 | 7 | | relating to the accrual of vacation and sick leave for certain state |

| 8 | 8 | | employees on a military leave of absence. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 661.904(b) and (c), Government Code, |
|---|
| 11 | 11 | | are amended to read as follows: |
|---|
| 12 | 12 | | (b) The employee on an unpaid leave of absence during |
|---|
| 13 | 13 | | military duty described by Subsection (a) continues to accrue: |
|---|
| 14 | 14 | | (1) state service credit for purposes of longevity |
|---|
| 15 | 15 | | pay; |
|---|
| 16 | 16 | | (2) [while on military duty described by Subsection |
|---|
| 17 | 17 | | (a) but does not accrue] vacation leave; and |
|---|
| 18 | 18 | | (3) [or] sick leave [during an unpaid leave of |
|---|
| 19 | 19 | | absence]. |
|---|
| 20 | 20 | | (c) The employee may retain any accrued vacation or sick |
|---|
| 21 | 21 | | leave and is entitled to be credited with those balances on return |
|---|
| 22 | 22 | | to state employment from military duty described by Subsection (a). |
|---|
| 23 | 23 | | Leave earned while on an unpaid leave of absence during military |
|---|
| 24 | 24 | | duty described by Subsection (a) [in a state-paid status] is |
|---|
| 25 | 25 | | credited to the employee's balance when the employee returns to |
|---|
| 26 | 26 | | active state employment. |
|---|
| 27 | 27 | | SECTION 2. This Act takes effect immediately if it receives |
|---|
| 28 | 28 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 29 | 29 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 30 | 30 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 31 | 31 | | Act takes effect September 1, 2009. |
