55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the accrual of vacation and sick leave for certain state
88 employees on a military leave of absence.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 661.904(b) and (c), Government Code,
1111 are amended to read as follows:
1212 (b) The employee on an unpaid leave of absence during
1313 military duty described by Subsection (a) continues to accrue:
1414 (1) state service credit for purposes of longevity
1515 pay;
1616 (2) [while on military duty described by Subsection
1717 (a) but does not accrue] vacation leave; and
1818 (3) [or] sick leave [during an unpaid leave of
1919 absence].
2020 (c) The employee may retain any accrued vacation or sick
2121 leave and is entitled to be credited with those balances on return
2222 to state employment from military duty described by Subsection (a).
2323 Leave earned while on an unpaid leave of absence during military
2424 duty described by Subsection (a) [in a state-paid status] is
2525 credited to the employee's balance when the employee returns to
2626 active state employment.
2727 SECTION 2. This Act takes effect immediately if it receives
2828 a vote of two-thirds of all the members elected to each house, as
2929 provided by Section 39, Article III, Texas Constitution. If this
3030 Act does not receive the vote necessary for immediate effect, this
3131 Act takes effect September 1, 2009.
