| 9 | 9 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 10 | 10 | SECTION 1. Section 215.001(3), Labor Code, is amended to | |
| 11 | 11 | read as follows: | |
| 12 | 12 | (3) "Normal weekly hours of work" means the number of | |
| 13 | 13 | hours in a week that an employee ordinarily works for a | |
| 14 | 14 | participating employer or an average of 40 hours per week over a | |
| 15 | 15 | two-week pay period, whichever is less. | |
| 16 | 16 | SECTION 2. This Act takes effect immediately if it receives | |
| 17 | 17 | a vote of two-thirds of all the members elected to each house, as | |
| 18 | 18 | provided by Section 39, Article III, Texas Constitution. If this | |
| 19 | 19 | Act does not receive the vote necessary for immediate effect, this | |
| 20 | 20 | Act takes effect September 1, 2009. |
