77 relating to state compensation for certain election expenses.
88 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
99 SECTION 1. Section 32.091(c), Election Code, is amended to
1010 read as follows:
1111 (c) For a primary or runoff primary election, the minimum
1212 hourly rate is the greater of the maximum rate provided by
1313 Subsection (a) or, if the election officer attended a training
1414 program as provided by Subchapter F, $10 [$7].
1515 SECTION 2. Subchapter E, Chapter 32, Election Code, is
1616 amended by adding Section 32.095 to read as follows:
1717 Sec. 32.095. LEAVE FOR SERVICE AS ELECTION JUDGE OR CLERK.
1818 A deduction may not be made from the salary, wages, or accrued leave
1919 of an officer or employee of the state or a political subdivision of
2020 the state because the officer or employee serves as an election
2121 judge or clerk. A deduction prohibited by this section includes a
2222 deduction for any fee or compensation the employee receives for
2323 serving as an election judge or clerk.
2424 SECTION 3. Section 32.114(e), Election Code, is amended to
2525 read as follows:
2626 (e) An election judge, early voting clerk, or deputy early
2727 voting clerk in charge of an early voting polling place is entitled
2828 to compensation for attending the training program at an hourly
2929 rate not to exceed $10 [$7].
3030 SECTION 4. Section 173.007(b), Election Code, is amended to
3131 read as follows:
3232 (b) Rules adopted under this section must provide for state
3333 compensation for a sufficient number of polling places in each
3434 county to adequately serve its voters, taking into account the
3535 area, geographic features, estimated voter turnout, and other
3636 relevant factors. The state compensation must be proportional to
3737 the number of polling places in a county, but in no case may state
3838 compensation be limited to fewer than one polling place for each
3939 commissioners precinct.
4040 SECTION 5. This Act takes effect September 1, 2009.
