66 AN ACT
77 relating to the extent and management of the John Graves Scenic
88 Riverway.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 26.551(2), Water Code, is amended to
1111 read as follows:
1212 (2) "John Graves Scenic Riverway" means that portion
1313 of the Brazos River Basin, and its contributing watershed, located
1414 downstream of the Morris Shepard Dam on the Possum Kingdom
1515 Reservoir in Palo Pinto County, Texas, and extending to the county
1616 line between Somervell and Bosque [Parker and Hood] Counties,
1717 Texas, including that portion of the river basin and contributing
1818 watershed in Johnson County.
1919 SECTION 2. Section 26.555(b), Water Code, is amended to
2020 read as follows:
2121 (b) The visual inspections and the drawing of water samples
2222 must be conducted at least once in a winter month and at least once
2323 in a summer month. The visual inspections must be conducted [both]
2424 from the surface of the John Graves Scenic Riverway or [and] from an
2525 aircraft flying over the riverway.
2626 SECTION 3. The Texas Commission on Environmental Quality as
2727 soon as practicable shall amend its rules as necessary to include in
2828 the John Graves Scenic Riverway pilot program under Subchapter M,
2929 Chapter 26, Water Code, the area added to the John Graves Scenic
3030 Riverway by this Act. The commission shall begin enforcement of
3131 Subchapter M, Chapter 26, Water Code, in the area added to the John
3232 Graves Scenic Riverway on January 1, 2010.
3333 SECTION 4. This Act takes effect immediately if it receives
3434 a vote of two-thirds of all the members elected to each house, as
3535 provided by Section 39, Article III, Texas Constitution. If this
3636 Act does not receive the vote necessary for immediate effect, this
3737 Act takes effect September 1, 2009.
