| 7 | 7 | | relating to the extent and management of the John Graves Scenic |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 26.551(2), Water Code, is amended to |
|---|
| 11 | 11 | | read as follows: |
|---|
| 12 | 12 | | (2) "John Graves Scenic Riverway" means that portion |
|---|
| 13 | 13 | | of the Brazos River Basin, and its contributing watershed, located |
|---|
| 14 | 14 | | downstream of the Morris Shepard Dam on the Possum Kingdom |
|---|
| 15 | 15 | | Reservoir in Palo Pinto County, Texas, and extending to the county |
|---|
| 16 | 16 | | line between Somervell and Bosque [Parker and Hood] Counties, |
|---|
| 17 | 17 | | Texas, including that portion of the river basin and contributing |
|---|
| 18 | 18 | | watershed in Johnson County. |
|---|
| 19 | 19 | | SECTION 2. Section 26.555(b), Water Code, is amended to |
|---|
| 20 | 20 | | read as follows: |
|---|
| 21 | 21 | | (b) The visual inspections and the drawing of water samples |
|---|
| 22 | 22 | | must be conducted at least once in a winter month and at least once |
|---|
| 23 | 23 | | in a summer month. The visual inspections must be conducted [both] |
|---|
| 24 | 24 | | from the surface of the John Graves Scenic Riverway or [and] from an |
|---|
| 25 | 25 | | aircraft flying over the riverway. |
|---|
| 26 | 26 | | SECTION 3. The Texas Commission on Environmental Quality as |
|---|
| 27 | 27 | | soon as practicable shall amend its rules as necessary to include in |
|---|
| 28 | 28 | | the John Graves Scenic Riverway pilot program under Subchapter M, |
|---|
| 29 | 29 | | Chapter 26, Water Code, the area added to the John Graves Scenic |
|---|
| 30 | 30 | | Riverway by this Act. The commission shall begin enforcement of |
|---|
| 31 | 31 | | Subchapter M, Chapter 26, Water Code, in the area added to the John |
|---|
| 32 | 32 | | Graves Scenic Riverway on January 1, 2010. |
|---|
| 33 | 33 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 34 | 34 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 35 | 35 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 36 | 36 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 37 | 37 | | Act takes effect September 1, 2009. |
