77 relating to a career ladder for interveners who provide services
88 under the deaf-blind with multiple disabilities waiver program.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Subchapter B, Chapter 531, Government Code, is
1111 amended by adding Section 531.0973 to read as follows:
1212 Sec. 531.0973. DEAF-BLIND WITH MULTIPLE DISABILITIES
1313 WAIVER PROGRAM: CAREER LADDER FOR INTERVENERS. (a) In this
1414 section, "deaf-blind related course work" means educational
1515 courses designed to improve a student's:
1616 (1) knowledge of deaf-blindness and its effect on
1717 learning;
1818 (2) knowledge of the role of intervention and ability
1919 to facilitate the intervention process;
2020 (3) knowledge of areas of communication relevant to
2121 deaf-blindness, including methods, adaptations, and use of
2222 assistive technology, and ability to facilitate a deaf-blind
2323 person's development and use of communication skills;
2424 (4) knowledge of the effect that deaf-blindness has on
2525 a person's psychological, social, and emotional development and
2626 ability to facilitate the emotional well-being of a deaf-blind
2727 person;
2828 (5) knowledge of and issues related to sensory systems
2929 and ability to facilitate the use of the senses;
3030 (6) knowledge of motor skills , movement, orientation,
3131 and mobility strategies and ability to facilitate orientation and
3232 mobility skills;
3333 (7) knowledge of the effect that additional
3434 disabilities have on a deaf-blind person and ability to provide
3535 appropriate support; or
3636 (8) professionalism and knowledge of ethical issues
3737 relevant to the role of an intervener.
3838 (b) The executive commissioner by rule shall adopt a career
3939 ladder for persons who provide intervener services under the
4040 deaf-blind with multiple disabilities waiver program. The rules
4141 must provide a system under which each person may be classified
4242 based on the person's level of training, education, and experience,
4343 as one of the following:
4444 (1) Intervener-in-Training;
4545 (2) Intervener I;
4646 (3) Intervener II; or
4747 (4) Intervener III.
4848 (c) The rules adopted by the executive commissioner under
4949 Subsection (b) must, at a minimum, require that:
5050 (1) an Intervener-in-Training:
5151 (A) complete any orientation or training course
5252 that is required to be completed by any person who provides direct
5353 care services to recipients of services under the deaf-blind with
5454 multiple disabilities waiver program; and
5555 (B) be actively pursuing classification as an
5656 Intervener I;
5757 (2) an Intervener I:
5858 (A) complete any orientation or training course
5959 described by Subdivision (1)(A);
6060 (B) hold a high school diploma or a high school
6161 equivalency certificate; and
6262 (C) have completed at least 10 semester credit
6363 hours, including a two-hour practicum in deaf-blind related course
6464 work, at a public or private institution of higher education;
6565 (3) an Intervener II:
6666 (A) meet the requirements of an Intervener I; and
6767 (B) have completed an additional 10 semester
6868 credit hours in deaf-blind related course work at a public or
6969 private institution of higher education; and
7070 (4) an Intervener III:
7171 (A) meet the requirements of an Intervener II;
7272 and
7373 (B) hold an associate's or bachelor's degree from
7474 a public or private institution of higher education.
7575 (d) Notwithstanding Subsections (b) and (c), the executive
7676 commissioner may adopt a career ladder under this section based on
7777 credentialing standards for interveners developed by the Academy
7878 for Certification of Vision Rehabilitation and Education
7979 Professionals or any other private credentialing entity that the
8080 executive commissioner determines is appropriate.
8181 (e) The compensation that an intervener receives for
8282 providing services under the deaf-blind with multiple disabilities
8383 waiver program must be based on and commensurate with the
8484 intervener's career ladder classification.
8585 SECTION 2. If before adopting rules under Section 531.0973,
8686 Government Code, as added by this Act, the executive commissioner
8787 of the Health and Human Services Commission determines that an
8888 amendment to this state's deaf-blind with multiple disabilities
8989 waiver under Section 1915(c) of the federal Social Security Act (42
9090 U.S.C. Section 1396n(c)) or other authorization from the federal
9191 Centers for Medicare and Medicaid Services or any other federal
9292 agency is necessary, the executive commissioner shall apply for and
9393 actively pursue the amendment or other authorization and may delay
9494 adopting rules under Section 531.0973, Government Code, as added by
9595 this Act, until the amendment or other authorization applied for
9696 under this section is granted.
9797 SECTION 3. This Act takes effect September 1, 2009.
