55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to use of money from the Texas Enterprise Fund or the Texas
88 emerging technology fund to promote alternative energy sources and
99 energy efficiency technologies.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Section 481.078, Government Code, is amended by
1212 adding Subsections (k) and (l) to read as follows:
1313 (k) At least 20 percent of the total amount of grants made
1414 from the fund must be to fund the establishment and expansion of
1515 enterprises in this state that have as their primary purpose:
1616 (1) the provision of energy derived from alternative
1717 energy sources; or
1818 (2) the conservation of energy resources through
1919 energy efficiency technology.
2020 (l) For purposes of Subsection (k):
2121 (1) "Alternative energy source" means an energy
2222 source, including solar energy, biomass energy, geothermal energy,
2323 and wind energy, that does not depend on nuclear fuel or
2424 nonrenewable fossil fuel.
2525 (2) "Energy efficiency technology" means technology
2626 that is aimed at reducing the rate at which electric energy is used
2727 by equipment or processes and may be achieved by:
2828 (A) substituting more advanced equipment to
2929 produce the same level of end-use services with less electricity;
3030 (B) adopting technology and processes that
3131 reduce heat or other energy losses; or
3232 (C) reorganizing processes to make use of waste
3333 heat.
3434 SECTION 2. Section 490.151, Government Code, is amended by
3535 amending Subsection (a) and adding Subsections (c) and (d) to read
3636 as follows:
3737 (a) Subject to Subsection (c), amounts [Amounts] allocated
3838 from the fund for use as provided by this subchapter shall be
3939 reserved for incentives for private or nonprofit entities to
4040 collaborate with public or private institutions of higher education
4141 in this state on emerging technology projects with a demonstrable
4242 economic benefit to this state.
4343 (c) The governor, lieutenant governor, and speaker of the
4444 house of representatives shall ensure that at least 30 percent of
4545 the amounts allocated from the fund for use as provided by this
4646 subchapter shall be used for initiatives that promote alternative
4747 energy sources or energy efficiency technologies.
4848 (d) In this section:
4949 (1) "Alternative energy source" means an energy
5050 source, including solar energy, biomass energy, geothermal energy,
5151 and wind energy, that does not depend on nuclear fuel or
5252 nonrenewable fossil fuel.
5353 (2) "Energy efficiency technology" means technology
5454 that is aimed at reducing the rate at which electric energy is used
5555 by equipment or processes and may be achieved by:
5656 (A) substituting more advanced equipment to
5757 produce the same level of end-use services with less electricity;
5858 (B) adopting technology and processes that
5959 reduce heat or other energy losses; or
6060 (C) reorganizing processes to make use of waste
6161 heat.
6262 SECTION 3. This Act takes effect immediately if it receives
6363 a vote of two-thirds of all the members elected to each house, as
6464 provided by Section 39, Article III, Texas Constitution. If this
6565 Act does not receive the vote necessary for immediate effect, this
6666 Act takes effect September 1, 2009.
