77 relating to the availability of certain Upper Trinity Groundwater
88 Conservation District financial information on the district's
99 Internet website.
1010 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1111 SECTION 1. Subchapter D, Chapter 8830, Special District
1212 Local Laws Code, is amended by adding Sections 8830.153, 8830.154,
1313 and 8830.155 to read as follows:
1414 Sec. 8830.153. ELECTRONIC CHECKING ACCOUNT TRANSACTION
1515 REGISTER. (a) The district shall maintain the transaction
1616 register for the district's checking account in a searchable
1717 electronic spreadsheet format, such as a portable document format
1818 (PDF) or similar file type, in which the transaction register is
1919 readily available for purposes of Subsection (c). Except as
2020 provided by Subsection (b), the electronic checking account
2121 transaction register must include for each check written from the
2222 district checking account:
2323 (1) the transaction amount;
2424 (2) the check number;
2525 (3) the name of the payee; and
2626 (4) a statement of the purpose of the expenditure for
2727 which the check was written.
2828 (b) The district may not include in the district's
2929 electronic checking account transaction register a check issued to
3030 district personnel in payment of:
3131 (1) salary, wages, or an employment stipend; or
3232 (2) a workers' compensation income benefit, medical
3333 benefit, death benefit, or burial benefit that is issued by the
3434 district.
3535 (c) The district shall prominently post the electronic
3636 checking account transaction register at all times on the
3737 district's Internet website for viewing and downloading by
3838 interested persons.
3939 (d) The district shall:
4040 (1) update the electronic checking account
4141 transaction register at least once each month, not later than the
4242 30th day after the closing date of the most recent monthly statement
4343 for the checking account; and
4444 (2) maintain each transaction or listing in the
4545 electronic checking account transaction register on the district's
4646 Internet website until the second anniversary of the date of the
4747 transaction or listing.
4848 Sec. 8830.154. POSTING OF DISTRICT CREDIT CARD
4949 TRANSACTIONS. (a) The district shall post on the district's
5050 Internet website a monthly listing of each transaction made using a
5151 credit card issued to:
5252 (1) the district; or
5353 (2) a district officer or employee for use in
5454 connection with district business.
5555 (b) The listing of credit card transactions under
5656 Subsection (a) must include, for each transaction:
5757 (1) the month and year of the transaction;
5858 (2) the amount of the transaction; and
5959 (3) the name of the payee.
6060 (c) The district may comply with Subsection (a) by posting a
6161 credit card statement on the district's Internet website. Before
6262 posting a credit card statement as permitted by this subsection,
6363 the district shall remove or obliterate the name of the credit card
6464 issuer, the credit card number, the name of the person to whom the
6565 card is issued, the day of the month on which each transaction shown
6666 was made, and the expiration date.
6767 (d) The district shall:
6868 (1) post each credit card transaction not later than
6969 the 30th day after the first date the district pays any portion of
7070 the balance due shown on the credit card statement that contains the
7171 transaction; and
7272 (2) maintain the listing of a credit card transaction
7373 on the district's Internet website until the second anniversary of
7474 the date of the transaction.
7575 Sec. 8830.155. POSTING OF DISTRICT PERSONNEL COMPENSATION
7676 INFORMATION. (a) In this section, "compensation" means salaries,
7777 wages, and employment stipends.
7878 (b) Not later than the first day of each fiscal year, the
7979 district shall post on the district's Internet website a listing of
8080 the total amounts budgeted for the compensation of district
8181 personnel for the year, grouped by the following categories:
8282 (1) operators and field inspectors;
8383 (2) professional service providers;
8484 (3) administrative staff; and
8585 (4) all other employees.
8686 (c) For each category under Subsection (b), the district
8787 shall post:
8888 (1) the number of full-time personnel; and
8989 (2) the average compensation.
9090 (d) The district shall maintain the personnel compensation
9191 information for a year on the district's Internet website until the
9292 district posts the information for the following year.
9393 SECTION 2. The Upper Trinity Groundwater Conservation
9494 District shall make the first Internet postings required by
9595 Sections 8830.153, 8830.154, and 8830.155, Special District Local
9696 Laws Code, as added by this Act, not later than January 1, 2010.
9797 SECTION 3. This Act takes effect immediately if it receives
9898 a vote of two-thirds of all the members elected to each house, as
9999 provided by Section 39, Article III, Texas Constitution. If this
100100 Act does not receive the vote necessary for immediate effect, this
101101 Act takes effect September 1, 2009.
