6	6	AN ACT
7	7	relating to the availability of certain Upper Trinity Groundwater
8	8	Conservation District financial information on the district's
9	9	Internet website.
10	10	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
11	11	SECTION 1. Subchapter D, Chapter 8830, Special District
12	12	Local Laws Code, is amended by adding Sections 8830.153, 8830.154,
13	13	and 8830.155 to read as follows:
14	14	Sec. 8830.153. ELECTRONIC CHECKING ACCOUNT TRANSACTION
15	15	REGISTER. (a) The district shall maintain the transaction
16	16	register for the district's checking account in a searchable
17	17	electronic spreadsheet format, such as a portable document format
18	18	(PDF) or similar file type, in which the transaction register is
19	19	readily available for purposes of Subsection (c). Except as
20	20	provided by Subsection (b), the electronic checking account
21	21	transaction register must include for each check written from the
22	22	district checking account:
23	23	(1) the transaction amount;
24	24	(2) the check number;
25	25	(3) the name of the payee; and
26	26	(4) a statement of the purpose of the expenditure for
27	27	which the check was written.
28	28	(b) The district may not include in the district's
29	29	electronic checking account transaction register a check issued to
30	30	district personnel in payment of:
31	31	(1) salary, wages, or an employment stipend; or
32	32	(2) a workers' compensation income benefit, medical
33	33	benefit, death benefit, or burial benefit that is issued by the
34	34	district.
35	35	(c) The district shall prominently post the electronic
36	36	checking account transaction register at all times on the
37	37	district's Internet website for viewing and downloading by
38	38	interested persons.
39	39	(d) The district shall:
40	40	(1) update the electronic checking account
41	41	transaction register at least once each month, not later than the
42	42	30th day after the closing date of the most recent monthly statement
43	43	for the checking account; and
44	44	(2) maintain each transaction or listing in the
45	45	electronic checking account transaction register on the district's
46	46	Internet website until the second anniversary of the date of the
47	47	transaction or listing.
48	48	Sec. 8830.154. POSTING OF DISTRICT CREDIT CARD
49	49	TRANSACTIONS. (a) The district shall post on the district's
50	50	Internet website a monthly listing of each transaction made using a
51	51	credit card issued to:
52	52	(1) the district; or
53	53	(2) a district officer or employee for use in
54	54	connection with district business.
55	55	(b) The listing of credit card transactions under
56	56	Subsection (a) must include, for each transaction:
57	57	(1) the month and year of the transaction;
58	58	(2) the amount of the transaction; and
59	59	(3) the name of the payee.
60	60	(c) The district may comply with Subsection (a) by posting a
61	61	credit card statement on the district's Internet website. Before
62	62	posting a credit card statement as permitted by this subsection,
63	63	the district shall remove or obliterate the name of the credit card
64	64	issuer, the credit card number, the name of the person to whom the
65	65	card is issued, the day of the month on which each transaction shown
66	66	was made, and the expiration date.
67	67	(d) The district shall:
68	68	(1) post each credit card transaction not later than
69	69	the 30th day after the first date the district pays any portion of
70	70	the balance due shown on the credit card statement that contains the
71	71	transaction; and
72	72	(2) maintain the listing of a credit card transaction
73	73	on the district's Internet website until the second anniversary of
74	74	the date of the transaction.
75	75	Sec. 8830.155. POSTING OF DISTRICT PERSONNEL COMPENSATION
76	76	INFORMATION. (a) In this section, "compensation" means salaries,
77	77	wages, and employment stipends.
78	78	(b) Not later than the first day of each fiscal year, the
79	79	district shall post on the district's Internet website a listing of
80	80	the total amounts budgeted for the compensation of district
81	81	personnel for the year, grouped by the following categories:
82	82	(1) operators and field inspectors;
83	83	(2) professional service providers;
84	84	(3) administrative staff; and
85	85	(4) all other employees.
86	86	(c) For each category under Subsection (b), the district
87	87	shall post:
88	88	(1) the number of full-time personnel; and
89	89	(2) the average compensation.
90	90	(d) The district shall maintain the personnel compensation
91	91	information for a year on the district's Internet website until the
92	92	district posts the information for the following year.
93	93	SECTION 2. The Upper Trinity Groundwater Conservation
94	94	District shall make the first Internet postings required by
95	95	Sections 8830.153, 8830.154, and 8830.155, Special District Local
96	96	Laws Code, as added by this Act, not later than January 1, 2010.
97	97	SECTION 3. This Act takes effect immediately if it receives
98	98	a vote of two-thirds of all the members elected to each house, as
99	99	provided by Section 39, Article III, Texas Constitution. If this
100	100	Act does not receive the vote necessary for immediate effect, this
101	101	Act takes effect September 1, 2009.
