66 AN ACT
77 relating to the composition of the board of trustees of the Teacher
88 Retirement System of Texas.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Sections 825.002(a), (c), and (e), Government
1111 Code, are amended to read as follows:
1212 (a) The governor shall appoint, with the advice and consent
1313 of the senate and as provided by this section, the [seven] members
1414 of the board of trustees.
1515 (c) The governor shall appoint three [two] members of the
1616 board from a slate of four [three] members of the retirement system
1717 who are currently employed by a public school district and who have
1818 been nominated in accordance with Subsection (f) by the members of
1919 the retirement system whose most recent credited service was
2020 performed for a public school district. The three [two] members
2121 hold office for staggered terms.
2222 (e) The governor shall appoint two members [one member] from
2323 a slate of four [three] members of the retirement system who are
2424 currently employed by an institution of higher education and who
2525 have been nominated in accordance with Subsection (f) by the
2626 members of the retirement system whose most recent credited service
2727 was performed for an institution of higher education.
2828 SECTION 2. Section 825.003, Government Code, is repealed.
2929 SECTION 3. (a) The change in law made by this Act does not
3030 apply to the term of a member of the board of trustees of the Teacher
3131 Retirement System of Texas serving as an appointee under Section
3232 825.003, Government Code, immediately before the effective date of
3333 this Act. Notwithstanding Section 825.004(b), Government Code,
3434 members appointed to fill vacancies in positions appointed under
3535 former Section 825.003, Government Code, occurring on or after the
3636 effective date of this Act must be appointed for the remainder of
3737 the term in accordance with Sections 825.002(c) and (e), Government
3838 Code, as amended by this Act.
3939 (b) The change in law made by this Act does not prohibit a
4040 member of the board of trustees of the Teacher Retirement System of
4141 Texas who was appointed under Section 825.003, Government Code,
4242 before the effective date of this Act from being a nominee for or
4343 serving as a member of the board of trustees under Section 825.002,
4444 Government Code, on or after the effective date of this Act if the
4545 person is otherwise qualified to serve on the board of trustees.
4646 SECTION 4. This Act takes effect immediately if it receives
4747 a vote of two-thirds of all the members elected to each house, as
4848 provided by Section 39, Article III, Texas Constitution. If this
4949 Act does not receive the vote necessary for immediate effect, this
5050 Act takes effect September 1, 2009.
