| 7 | 7 | | relating to the composition of the board of trustees of the Teacher |

| 8 | 8 | | Retirement System of Texas. |
|---|
| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Sections 825.002(a), (c), and (e), Government |
|---|
| 11 | 11 | | Code, are amended to read as follows: |
|---|
| 12 | 12 | | (a) The governor shall appoint, with the advice and consent |
|---|
| 13 | 13 | | of the senate and as provided by this section, the [seven] members |
|---|
| 14 | 14 | | of the board of trustees. |
|---|
| 15 | 15 | | (c) The governor shall appoint three [two] members of the |
|---|
| 16 | 16 | | board from a slate of four [three] members of the retirement system |
|---|
| 17 | 17 | | who are currently employed by a public school district and who have |
|---|
| 18 | 18 | | been nominated in accordance with Subsection (f) by the members of |
|---|
| 19 | 19 | | the retirement system whose most recent credited service was |
|---|
| 20 | 20 | | performed for a public school district. The three [two] members |
|---|
| 21 | 21 | | hold office for staggered terms. |
|---|
| 22 | 22 | | (e) The governor shall appoint two members [one member] from |
|---|
| 23 | 23 | | a slate of four [three] members of the retirement system who are |
|---|
| 24 | 24 | | currently employed by an institution of higher education and who |
|---|
| 25 | 25 | | have been nominated in accordance with Subsection (f) by the |
|---|
| 26 | 26 | | members of the retirement system whose most recent credited service |
|---|
| 27 | 27 | | was performed for an institution of higher education. |
|---|
| 28 | 28 | | SECTION 2. Section 825.003, Government Code, is repealed. |
|---|
| 29 | 29 | | SECTION 3. (a) The change in law made by this Act does not |
|---|
| 30 | 30 | | apply to the term of a member of the board of trustees of the Teacher |
|---|
| 31 | 31 | | Retirement System of Texas serving as an appointee under Section |
|---|
| 32 | 32 | | 825.003, Government Code, immediately before the effective date of |
|---|
| 33 | 33 | | this Act. Notwithstanding Section 825.004(b), Government Code, |
|---|
| 34 | 34 | | members appointed to fill vacancies in positions appointed under |
|---|
| 35 | 35 | | former Section 825.003, Government Code, occurring on or after the |
|---|
| 36 | 36 | | effective date of this Act must be appointed for the remainder of |
|---|
| 37 | 37 | | the term in accordance with Sections 825.002(c) and (e), Government |
|---|
| 38 | 38 | | Code, as amended by this Act. |
|---|
| 39 | 39 | | (b) The change in law made by this Act does not prohibit a |
|---|
| 40 | 40 | | member of the board of trustees of the Teacher Retirement System of |
|---|
| 41 | 41 | | Texas who was appointed under Section 825.003, Government Code, |
|---|
| 42 | 42 | | before the effective date of this Act from being a nominee for or |
|---|
| 43 | 43 | | serving as a member of the board of trustees under Section 825.002, |
|---|
| 44 | 44 | | Government Code, on or after the effective date of this Act if the |
|---|
| 45 | 45 | | person is otherwise qualified to serve on the board of trustees. |
|---|
| 46 | 46 | | SECTION 4. This Act takes effect immediately if it receives |
|---|
| 47 | 47 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 48 | 48 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 49 | 49 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 50 | 50 | | Act takes effect September 1, 2009. |
