6	6	AN ACT
7	7	relating to the sale of certain alcoholic beverages to private club
8	8	registration permit holders.
9	9	BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
10	10	SECTION 1. Section 19.01, Alcoholic Beverage Code, is
11	11	amended to read as follows:
12	12	Sec. 19.01. AUTHORIZED ACTIVITIES. The holder of a
13	13	wholesaler's permit may:
14	14	(1) purchase and import liquor from distillers,
15	15	brewers, wineries, wine bottlers, rectifiers, and manufacturers
16	16	who are holders of nonresident seller's permits or from their
17	17	agents who hold manufacturer's agents permits;
18	18	(2) purchase liquor from other wholesalers in the
19	19	state;
20	20	(3) sell liquor in the original containers in which it
21	21	is received to retailers and wholesalers in this state authorized
22	22	to sell the liquor; [and]
23	23	(4) sell liquor to qualified persons outside the
24	24	state; and
25	25	(5) sell ale and malt liquor to a holder of a private
26	26	club registration permit.
27	27	SECTION 2. Section 20.01, Alcoholic Beverage Code, is
28	28	amended to read as follows:
29	29	Sec. 20.01. AUTHORIZED ACTIVITIES. The holder of a general
30	30	class B wholesaler's permit may:
31	31	(1) purchase and import malt and vinous liquors from
32	32	brewers, wineries, rectifiers, and wine manufacturers and wine
33	33	bottlers who are the holders of nonresident seller's permits or
34	34	their agents who are holders of manufacturer's agent permits;
35	35	(2) purchase malt and vinous liquors from holders of
36	36	brewer's permits or other wholesalers in the state;
37	37	(3) sell the malt and vinous liquors in the original
38	38	containers in which they are received to retailers and wholesalers
39	39	authorized to sell them in this state, including holders of local
40	40	distributor's permits, mixed beverage permits, and daily temporary
41	41	mixed beverage permits; [and]
42	42	(4) sell the malt and vinous liquors to qualified
43	43	persons outside the state; and
44	44	(5) sell ale and malt liquor to a holder of a private
45	45	club registration permit.
46	46	SECTION 3. Section 21.01, Alcoholic Beverage Code, is
47	47	amended to read as follows:
48	48	Sec. 21.01. AUTHORIZED ACTIVITIES. The holder of a local
49	49	class B wholesaler's permit may:
50	50	(1) purchase and import malt and vinous liquors from
51	51	brewers, wineries, rectifiers, and wine manufacturers and bottlers
52	52	who are holders of nonresident seller's permits and from their
53	53	agents who are holders of manufacturer's agent permits;
54	54	(2) purchase malt and vinous liquors from holders of
55	55	brewer's permits and from other wholesalers in the state; [and]
56	56	(3) sell the malt and vinous liquors, in the original
57	57	containers in which he receives them, to general and local class B
58	58	wholesaler's permittees and, in his county of residence, to local
59	59	distributor's permittees and retailers, including mixed beverage
60	60	permittees and daily temporary mixed beverage permittees; and
61	61	(4) sell ale and malt liquor to a holder of a private
62	62	club registration permit.
63	63	SECTION 4. This Act takes effect September 1, 2009.
