55 A BILL TO BE ENTITLED
66 AN ACT
77 relating to the sale of certain alcoholic beverages to private club
88 registration permit holders.
99 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
1010 SECTION 1. Section 19.01, Alcoholic Beverage Code, is
1111 amended to read as follows:
1212 Sec. 19.01. AUTHORIZED ACTIVITIES. The holder of a
1313 wholesaler's permit may:
1414 (1) purchase and import liquor from distillers,
1515 brewers, wineries, wine bottlers, rectifiers, and manufacturers
1616 who are holders of nonresident seller's permits or from their
1717 agents who hold manufacturer's agents permits;
1818 (2) purchase liquor from other wholesalers in the
1919 state;
2020 (3) sell liquor in the original containers in which it
2121 is received to retailers and wholesalers in this state authorized
2222 to sell the liquor; [and]
2323 (4) sell liquor to qualified persons outside the
2424 state; and
2525 (5) sell ale and malt liquor to a holder of a private
2626 club registration permit.
2727 SECTION 2. Section 20.01, Alcoholic Beverage Code, is
2828 amended to read as follows:
2929 Sec. 20.01. AUTHORIZED ACTIVITIES. The holder of a general
3030 class B wholesaler's permit may:
3131 (1) purchase and import malt and vinous liquors from
3232 brewers, wineries, rectifiers, and wine manufacturers and wine
3333 bottlers who are the holders of nonresident seller's permits or
3434 their agents who are holders of manufacturer's agent permits;
3535 (2) purchase malt and vinous liquors from holders of
3636 brewer's permits or other wholesalers in the state;
3737 (3) sell the malt and vinous liquors in the original
3838 containers in which they are received to retailers and wholesalers
3939 authorized to sell them in this state, including holders of local
4040 distributor's permits, mixed beverage permits, and daily temporary
4141 mixed beverage permits; [and]
4242 (4) sell the malt and vinous liquors to qualified
4343 persons outside the state; and
4444 (5) sell ale and malt liquor to a holder of a private
4545 club registration permit.
4646 SECTION 3. Section 21.01, Alcoholic Beverage Code, is
4747 amended to read as follows:
4848 Sec. 21.01. AUTHORIZED ACTIVITIES. The holder of a local
4949 class B wholesaler's permit may:
5050 (1) purchase and import malt and vinous liquors from
5151 brewers, wineries, rectifiers, and wine manufacturers and bottlers
5252 who are holders of nonresident seller's permits and from their
5353 agents who are holders of manufacturer's agent permits;
5454 (2) purchase malt and vinous liquors from holders of
5555 brewer's permits and from other wholesalers in the state; [and]
5656 (3) sell the malt and vinous liquors, in the original
5757 containers in which he receives them, to general and local class B
5858 wholesaler's permittees and, in his county of residence, to local
5959 distributor's permittees and retailers, including mixed beverage
6060 permittees and daily temporary mixed beverage permittees; and
6161 (4) sell ale and malt liquor to a holder of a private
6262 club registration permit.
6363 SECTION 4. This Act takes effect September 1, 2009.
