55 relating to the Muenster Hospital District.
66 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
77 SECTION 1. Chapter 477, Acts of the 59th Legislature,
88 Regular Session, 1965, is amended by adding Sections 9A and 9B to
99 read as follows:
1010 Sec. 9A. In addition to the authority to issue general
1111 obligation bonds and revenue bonds under this Act, the Board may
1212 provide for the security and payment of District bonds from a pledge
1313 of a combination of ad valorem taxes as authorized by Section 9 of
1414 this Act and revenue and other sources authorized by Section 7 of
1515 this Act.
1616 Sec. 9B. The District may use the proceeds of bonds issued
1717 under this Act to pay:
1818 (1) any expense the Board determines is reasonable and
1919 necessary to issue, sell, and deliver the bonds;
2020 (2) interest payments on the bonds during a period of
2121 acquisition or construction of a project or facility to be provided
2222 through the bonds, not to exceed five years;
2323 (3) costs related to the operation and maintenance of
2424 a project or facility to be provided through the bonds:
2525 (A) during an estimated period of acquisition or
2626 construction, not to exceed five years; and
2727 (B) for one year after the project or facility is
2828 acquired or constructed;
2929 (4) costs related to the financing of the bond funds,
3030 including debt service reserve and contingency funds;
3131 (5) costs related to the bond issuance;
3232 (6) costs related to the acquisition of land or
3333 interests in land for a project or facility to be provided through
3434 the bonds; and
3535 (7) costs of construction of a project or facility to
3636 be provided through the bonds, including the payment of related
3737 professional services and expenses.
3838 SECTION 2. Section 20a(a), Chapter 477, Acts of the 59th
3939 Legislature, Regular Session, 1965, is amended to read as follows:
4040 Sec. 20a. (a) The [If the Board of Directors declares that
4141 funds are not available to meet the lawfully authorized obligations
4242 of the District and that an emergency exists, the] Board may borrow
4343 money at a rate not to exceed the maximum annual percentage rate
4444 allowed by law for District obligations at the time of the loan.
4545 SECTION 3. Section 20a(d), Chapter 477, Acts of the 59th
4646 Legislature, Regular Session, 1965, is repealed.
4747 SECTION 4. This Act takes effect immediately if it receives
4848 a vote of two-thirds of all the members elected to each house, as
4949 provided by Section 39, Article III, Texas Constitution. If this
5050 Act does not receive the vote necessary for immediate effect, this
5151 Act takes effect September 1, 2009.
