55 AN ACT
66 relating to accountability for gifted and talented programs
77 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
88 SECTION 1. Chapter 39, Education Code, is amended by adding
99 Section 39.117, to read as follows:
1010 Section 39.117. GIFTED AND TALENTED STANDARDS. The
1111 commissioner shall adopt standards for the evaluation of gifted and
1212 talented programs. A school that uses the Texas Performance
1313 Standards Project or another program approved by the commissioner
1414 that meets the requirements of the Texas state plan for the
1515 education of gifted and talented students under section 29.123 and
1616 receives a satisfactory rating under the standards set by the
1717 commissioner shall not be subject to the limitation under 42.156
1818 (c) for the following two school years. If a district fails to
1919 receive a satisfactory rating for two consecutive school years, it
2020 shall be subject to the limitation under 42.156 (c) until the year
2121 following a satisfactory rating.
2222 Section 2. Section 42.156 (c) is amended to read as follows:
2323 (c) Except as provided in Section 39.117, not more than five
2424 percent of a district's students in average daily attendance are
2525 eligible for funding under this section.
2626 Section 3. The commissioner shall adopt standards for the
2727 evaluation of gifted and talented programs for the evaluation of
2828 gifted and talented programs no later than September 1, 2010.
2929 Section 4. This Act takes effect September 1, 2009.
