| 7 | 7 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 8 | 8 | | SECTION 1. Chapter 39, Education Code, is amended by adding |
|---|
| 9 | 9 | | Section 39.117, to read as follows: |
|---|
| 10 | 10 | | Section 39.117. GIFTED AND TALENTED STANDARDS. The |
|---|
| 11 | 11 | | commissioner shall adopt standards for the evaluation of gifted and |
|---|
| 12 | 12 | | talented programs. A school that uses the Texas Performance |
|---|
| 13 | 13 | | Standards Project or another program approved by the commissioner |
|---|
| 14 | 14 | | that meets the requirements of the Texas state plan for the |
|---|
| 15 | 15 | | education of gifted and talented students under section 29.123 and |
|---|
| 16 | 16 | | receives a satisfactory rating under the standards set by the |
|---|
| 17 | 17 | | commissioner shall not be subject to the limitation under 42.156 |
|---|
| 18 | 18 | | (c) for the following two school years. If a district fails to |
|---|
| 19 | 19 | | receive a satisfactory rating for two consecutive school years, it |
|---|
| 20 | 20 | | shall be subject to the limitation under 42.156 (c) until the year |
|---|
| 21 | 21 | | following a satisfactory rating. |

| 22 | 22 | | Section 2. Section 42.156 (c) is amended to read as follows: |

| 23 | 23 | | (c) Except as provided in Section 39.117, not more than five |
|---|
| 24 | 24 | | percent of a district's students in average daily attendance are |
|---|
| 25 | 25 | | eligible for funding under this section. |
|---|
| 26 | 26 | | Section 3. The commissioner shall adopt standards for the |
|---|
| 27 | 27 | | evaluation of gifted and talented programs for the evaluation of |
|---|
| 28 | 28 | | gifted and talented programs no later than September 1, 2010. |
|---|
| 29 | 29 | | Section 4. This Act takes effect September 1, 2009. |
