| 8 | 8 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 9 | 9 | | SECTION 1. Subchapter I, Chapter 39, Education Code, is |
|---|
| 10 | 10 | | amended by adding Section 39.205 to read as follows: |
|---|
| 11 | 11 | | Sec. 39.205. SOFTWARE STANDARDS. (a) The Department of |
|---|
| 12 | 12 | | Information Resources, in cooperation with the commissioner, shall |
|---|
| 13 | 13 | | adopt performance and interoperability standards for software used |
|---|
| 14 | 14 | | by school districts for financial accounting or attendance |
|---|
| 15 | 15 | | reporting. |
|---|
| 16 | 16 | | (b) Standards adopted under this section must ensure that |
|---|
| 17 | 17 | | the software will enable a school district to share and report |
|---|
| 18 | 18 | | information in a timely manner for purposes of financial |
|---|
| 19 | 19 | | management, operational decision-making, and transparency of |
|---|
| 20 | 20 | | district operations to the public. |
|---|
| 21 | 21 | | (c) The Department of Information Resources: |
|---|
| 22 | 22 | | (1) shall include compliance with standards adopted |
|---|
| 23 | 23 | | under this section as a requirement in any solicitation for |
|---|
| 24 | 24 | | software anticipated to be used for a purpose described by |
|---|
| 25 | 25 | | Subsection (a); |
|---|
| 26 | 26 | | (2) shall require a vendor awarded a contract in |
|---|
| 27 | 27 | | response to a solicitation described by Subdivision (1) to certify |
|---|
| 28 | 28 | | that the software complies with the standards adopted under this |
|---|
| 29 | 29 | | section; and |
|---|
| 30 | 30 | | (3) may negotiate state contract pricing for software |
|---|
| 31 | 31 | | that complies with the standards adopted under this section. |
|---|
| 32 | 32 | | SECTION 2. This Act takes effect September 1, 2009. |
