| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 16.032, Election Code, is amended to |
|---|
| 11 | 11 | | read as follows: |

| 12 | 12 | | Sec. 16.032. CANCELLATION FOLLOWING END OF SUSPENSE LIST |
|---|
| 13 | 13 | | PERIOD. (a) If on November 30 following the second general election |
|---|
| 14 | 14 | | for state and county officers that occurs after the date the voter's |
|---|
| 15 | 15 | | name is entered on the suspense list a registered voter's name |
|---|
| 16 | 16 | | appears on the suspense list, the registrar shall cancel the |
|---|
| 17 | 17 | | voter's registration unless the name is to be deleted from the list |
|---|
| 18 | 18 | | under Section 15.023. |
|---|
| 19 | 19 | | (b) For purposes of Subsection (a), if a voter whose name |
|---|
| 20 | 20 | | appears on the suspense list is shown to have voted in an election |
|---|
| 21 | 21 | | and the name is not to be deleted from the list under Section |
|---|
| 22 | 22 | | 15.023, the date on which the voter is considered to have been |
|---|
| 23 | 23 | | entered on the suspense list is the date of the most recent election |
|---|
| 24 | 24 | | in which the voter voted. |

| 25 | 25 | | SECTION 2. Section 63.0011, Election Code, is amended by |
|---|
| 26 | 26 | | adding Subsection (f) to read as follows: |
|---|
| 27 | 27 | | (f) The secretary of state shall adopt rules to provide for |
|---|
| 28 | 28 | | the uniform and auditable processing of a statement of residence |
|---|
| 29 | 29 | | required under this section. |
|---|
| 30 | 30 | | SECTION 3. This Act takes effect September 1, 2009. |
