| 7 | 7 | | relating to an allotment under the foundation school program for |

| 8 | 8 | | certain students who are military dependents. |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. Section 42.152, Education Code, is amended by |
|---|
| 11 | 11 | | adding Subsections (s), (s-1), (s-2), and (s-3) to read as follows: |
|---|
| 12 | 12 | | (s) In addition to the allotment provided under Subsection |
|---|
| 13 | 13 | | (a), a school district is entitled to an annual allotment equal to |
|---|
| 14 | 14 | | $650: |
|---|
| 15 | 15 | | (1) for each student in average daily attendance who |
|---|
| 16 | 16 | | has a parent or guardian who is serving on active duty in a combat |
|---|
| 17 | 17 | | zone as a member of the armed forces of the United States; and |
|---|
| 18 | 18 | | (2) for each student in average daily attendance who: |
|---|
| 19 | 19 | | (A) has a parent or guardian serving on active |
|---|
| 20 | 20 | | duty as a member of the armed forces of the United States; and |
|---|
| 21 | 21 | | (B) has transferred to a campus in the district |
|---|
| 22 | 22 | | during the school year as a result of a change in residence because |
|---|
| 23 | 23 | | of an action taken under the Defense Base Closure and Realignment |
|---|
| 24 | 24 | | Act of 1990 (10 U.S.C. Section 2687). |
|---|
| 25 | 25 | | (s-1) Notwithstanding any other provision of this section, |
|---|
| 26 | 26 | | a school district may use funds allotted to the district under |
|---|
| 27 | 27 | | Subsection (s) only to provide supplemental programs and services |
|---|
| 28 | 28 | | described by Subsection (c) for students described by Subsection |
|---|
| 29 | 29 | | (s) who are enrolled in the district. |
|---|
| 30 | 30 | | (s-2) The amount appropriated for allotments under |
|---|
| 31 | 31 | | Subsection (s) may not exceed $9.9 million in a school year. If the |
|---|
| 32 | 32 | | total amount of allotments to which districts are entitled under |
|---|
| 33 | 33 | | Subsection (s) for a school year exceeds the amount appropriated |
|---|
| 34 | 34 | | for allotments under that subsection, the commissioner shall reduce |
|---|
| 35 | 35 | | each district's allotment under that subsection proportionately. |
|---|
| 36 | 36 | | (s-3) Subsections (s), (s-1), (s-2), and this subsection |
|---|
| 37 | 37 | | expire September 1, 2012. |
|---|
| 38 | 38 | | SECTION 2. This Act takes effect September 1, 2009. |
