| 7 | 7 | | relating to the lease of certain state parking facilities to other |

| 9 | 9 | | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |

| 10 | 10 | | SECTION 1. The heading to Section 2165.2035, Government |
|---|
| 11 | 11 | | Code, is amended to read as follows: |
|---|
| 12 | 12 | | Sec. 2165.2035. LEASE OF SPACE IN STATE-OWNED PARKING LOTS |
|---|
| 13 | 13 | | AND GARAGES; USE AFTER HOURS. |
|---|
| 14 | 14 | | SECTION 2. Subchapter E, Chapter 2165, Government Code, is |
|---|
| 15 | 15 | | amended by adding Sections 2165.204 and 2165.2045 to read as |
|---|
| 16 | 16 | | follows: |
|---|
| 17 | 17 | | Sec. 2165.204. LEASE OF SPACE IN STATE-OWNED PARKING LOTS |
|---|
| 18 | 18 | | AND GARAGES; EXCESS INDIVIDUAL PARKING SPACES. (a) The commission |
|---|
| 19 | 19 | | may lease to a private individual an individual parking space in a |
|---|
| 20 | 20 | | state-owned parking lot or garage located in the city of Austin that |
|---|
| 21 | 21 | | the commission determines is not needed to accommodate the regular |
|---|
| 22 | 22 | | parking requirements of state employees who work near the lot or |
|---|
| 23 | 23 | | garage and visitors to nearby state government offices. |
|---|
| 24 | 24 | | (b) The commission may contract with a private vendor to |
|---|
| 25 | 25 | | manage leases under Subsection (a). |
|---|
| 26 | 26 | | (c) Money received from a lease under this section shall be |
|---|
| 27 | 27 | | deposited to the credit of the general revenue fund and may be |
|---|
| 28 | 28 | | appropriated only to fund the TEXAS grant program administered |
|---|
| 29 | 29 | | under Subchapter M, Chapter 56, Education Code. |
|---|
| 30 | 30 | | (d) On or before December 1 of each even-numbered year, the |
|---|
| 31 | 31 | | commission shall submit a report to the legislature and the |
|---|
| 32 | 32 | | Legislative Budget Board describing the effectiveness of the |
|---|
| 33 | 33 | | program under this section. |
|---|
| 34 | 34 | | Sec. 2165.2045. LEASE OF SPACE IN STATE-OWNED PARKING LOTS |
|---|
| 35 | 35 | | AND GARAGES; EXCESS BLOCKS OF PARKING SPACE. (a) The commission |
|---|
| 36 | 36 | | may lease to an institution of higher education, a private |
|---|
| 37 | 37 | | business, or a local government all or a significant block of a |
|---|
| 38 | 38 | | state-owned parking lot or garage located in the city of Austin that |
|---|
| 39 | 39 | | the commission determines is not needed to accommodate the regular |
|---|
| 40 | 40 | | parking requirements of state employees who work near the lot or |
|---|
| 41 | 41 | | garage and visitors to nearby state government offices. |

|---|
| 53 | 53 | | a vote of two-thirds of all the members elected to each house, as |
|---|
| 54 | 54 | | provided by Section 39, Article III, Texas Constitution. If this |
|---|
| 55 | 55 | | Act does not receive the vote necessary for immediate effect, this |
|---|
| 56 | 56 | | Act takes effect September 1, 2009. |
