| 8 | 8 | BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | |
| 9 | 9 | SECTION 1. Section 13.184, Water Code, is amended by adding | |
| 10 | 10 | Subsection (d) to read as follows: | |
| 11 | 11 | (d) A utility may file with the commission an application to | |
| 12 | 12 | increase the utility's rates not more than one time in a 36-month | |
| 13 | 13 | period. A rate increase under this section may not exceed 20 | |
| 14 | 14 | percent of the cost of the utility's rates at the time of the | |
| 15 | 15 | application. | |
| 16 | 16 | SECTION 2. The changes in law made to Section 13.184, Water | |
| 17 | 17 | Code, as amended by this Act, apply only to an application for a | |
| 18 | 18 | rate increase that is filed on or after the effective date of this | |
| 19 | 19 | Act. An application that is filed before the effective date of this | |
| 20 | 20 | Act is subject to the law in effect at that time, and that law is | |
| 21 | 21 | continued in effect for that purpose. | |
| 22 | 22 | SECTION 3. This Act takes effect September 1, 2009. |
